PAGE 1 OF 3 MOHAVE COUNTY BOARO OF SUPERVISORS RECORDIN~ FEE 0.00 He #3 RESOLUTION NO. 93-247 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN OF BEAVER DAM RESORT, TRACT 3015, BEING A SUBDIVISION OF A PORTION OF SECTION 5, TOWNSHIP 40 NORTH, RANGE 15 WEST, LOCATED IN THE LITTLEFIELD/BEAVER DAM PORTION OF THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1993, a public hearing was conducted to determine the approval of an Extension of Time for the approved Preliminary Subdivision Plan of BEAVER DAM RESORT, Tract 3015, and WHEREAS, the owner/developer of this tract is G. R. Frisby of Beaver Dam, Arizona. The engineer responsible for the preparation and design of this subdivision was Phylip Leslie, P.E., Rowley-Leslie Associates, Cedar City, Utah. The drainage study for the Beaver Dam Wash was prepared by Frank R. Liebrock and Hooper Knowlton, Jr., P.E.s, with AlE Intra Group, Inc., Salt Lake City, Utah, and WHEREAS, this proposed subdivision is located in the Arizona Strip, approximately one mile north of the I-1S/Littlefield interchange along County Route 91. The subject parcel is bounded by County Route 91 to the west and the Virgin River to the north. Access is provided to this proposed subdivision by County Route 91, a County Highway, and WHEREAS, this proposed subdivision as submitted and reviewed is a 32-acre parcel subdivided into 206 park model and RV lots, 33 twin home lots (66 units), and an 11-acre common area and golf course to be owned and maintained by the owner/subdivider, and WHEREAS, in a letter dated May 4, 1993, received by Planning and Zoning on May 11, 1993, Mr. Bob (G. R.) Frisby, the owner/developer, states, "As you may be aware we have been seeking approval for construction of Phase II. However, repeated delays by ADEQ Groundwater Permits have been costly from a time standpoint". In his letter dated July 8, 1993, received by fax on July 8, 1993, Mr. Frisby further states, "Beaver Dam Resort has been working to satisfy these requirements and fully expects all approvals in the next few weeks," and .., . . RESOLUTION NO. 93-247 Page 2 PAGE 2 OF 3 BK 2280 PG 359 (FEE~93-52081) WHEREAS, Article 3.10 states, "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken, then all proceedings relating to the plat shall be terminated," and WHEREAS, the Preliminary Subdivision plan was approved by the Mohave County Board of Supervisors on July 6, 1987, via P&ZC Resolution No. 87-100, and WHEREAS, BOS Resolution No. 91-260 brought the project into compliance by granting a third Extension of Time, effective until July 6, 1992. This Extension of Time was conditional upon the submitted Plat being brought up to the current code. On May 20, 1992, BOS Resolution No. 91-260 was amended by the Board of Supervisors via a Minute Entry action at the request of Mr. Frisby. This amendment removed the requirement that the submitted Plat be brought up to current standards, and WHEREAS, BOS Resolution No. 92-251 granted the fourth Extension of Time, to be effective until July 6, 1993, and WHEREAS, this will be the fifth Extension of Time, and WHEREAS, at the public hearing Planning Commission on August 11, recommended conditional approval of the Time subject to the following conditions: before the Mohave County 1993, the Commission requested Extension of 1. Compliance with all conditions stated below as set forth via Board of Supervisors action on May 20, 1992 (see attached Exhibit "A") which amended BOS Resolution No. 91-260. A. Provision of required financial assurances. B. Provision estimates. of acceptable construction cost c. Provision of evidence of approval by ADEQ of the proposed sewage disposal system. 2. This Extension of Time will be in effect until July 6, 1994, and RESOLUTION NO. 93-247 Page 3 PAGE 3QF 3 ~K 2280 PG 360 (FEE*93-520S1) NOW THEREFORE BE IT RESOLVED, that notice of hearing has been met and publiShed throughout this subdivision process as required by Arizona Revised Statutes and Mohave County Regulations, and the public was afforded notice of this action through advertisement of the Board of Supervisors meeting for this date. NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, September 7, 1993, approved this extension of time for the Preliminary Plan of BEAVER DAM RESORT, Tract 3015, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
