PAGE 1 OF 2 HOHAVE COUNTY BOARD OF SUPERVISORS RECOROI~G FEE 0.00 Ne RESOLUTION NO. 93-238 A RESOLUTION SETTING FORTH A ZONING USE PERMIT { ZUP } FOR THE ESTABLISHMENT OF A RESIDENTIAL HOME LOCATED IN A C-2 (GENERAL COMMERCIAL) ZONE, ON LOTS 35 AND 36, BLOCK 114, NEW KINGMAN ADDITION UNIT 8, TRACT 1101, SECTION 23, TOWNSHIP 16~ NORTH, RANGE 18 WEST, LOCATED APPROXIMATELY FIVE HUNDRED (500') FEET NORTH OF NORTHERN AVENUE' AND APPROXIMATELY TWO HUNDRED (200') FEET WEST OF NORTH BANK STREET, IN THE KINGMAN AREA. !~;:~.~.7:,.~ WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held August 2, 1993, a public hearing was conducted to determine whether approval should be granted to Ray and Eva Raper of Las Vegas, Nevada, for a zoning use permit, located on Lots 35 and 36, Block 114, New Kingman Addition, and .- ...~_\.~9 WHEREAS, Lots 35 and 36 are located approximately 500 feet north of Northern Avenue and approximately 200 f~et west of North Bank Street. The property is accessed from Northern Avenue via North Bank Street, north approximately 500 feet to Neal Avenue, thence west approximately 200 feet to the southeast corner of the subject property, and WHEREAS, review of Floodplain Map #040058-2165C indicates this property to be clear of a designated floodplain. The property is currently zoned C-2 (General Commercial), with C-2 property to the north, east and south. The property to the west is zoned R-M (Multiple-Family Residential) and R-1 (Single Family Residential) property further west. There currently is a vacant mobile home located on the property that has not been issued an occupancy permit by the Mohave County Building Department. The parcels to the north, east and south are currently vacant with the property to the east consisting of single family residences, and WHEREAS, the Zoning Use Permit is in connection to both lots. The two lots are under one ownership and will be processed as one lot. The permit will allow one home on both lots and will not allow a home on each individual lot, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 14, 1993, the Commission recommended APPROVAL of the requested Change of Use Permit with the applicant understanding and accepting the following conditions: ~.., .. . . RESOLUTION NO. 93-238 Page 2 I t :~ " 1. The applicant comply with all applicable provisions of sections of the Mohave County Zoning Regulations. 2. That appropriate zoning/building/environmental permits be obtained. 3. The zoning Use Permit is for the combination of both lots and will allow one home only on Lots 35 and 36. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This zoning Use "Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. 6. If these conditions are not met within one year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board, after notification by registered mail to th~.pwner and applicant who requested the rezoning, shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on June 26, 1993, and posted July 16, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 2, 1993, APPROVED this recommended by the Mohave County Planning and outlined herein.
