PAGE 1 OF 2 HOHAVE COUNTY 80ARD OF SUPERVISORS RECORDING FEE 0.00 Ne ~ RESOLUTION NO. 93-227 A RESOLUTION SETTING FORTH A REZONING OF LOT 522, UNIT 4, GOLDEN HORSESHOE RANCHOS, FROM C-2 (GENERAL COMMERCIAL) ZONE, PROPOSED TO BE A-R/lA (AGRICULTURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN SECTION 17, TOWNSHIP 27 NORTH, RANGE 19 WEST, LOCATED APPROXIMATELY SEVEN (7) MILES EAST OF STATE HIGHWAY 93 ALONG WHITE HILLS ROAD, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. ....,'"" i. ~\ (.: I , WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held August 2, 1993, a public hearing was conducted to determine whether approval should be granted to Jacqueline Brown of Kingman, Arizona, for a zone change from a C- 2 (General-Commercial Highway) to A-R (Agricultural-Residential) located on Lot 522, Golden Horseshoe Ranchos Unit 4, and ~.'- ;;'-,,' WHEREAS, Golden Horseshoe Ranchos Unit 4 is located approximately ten miles north of Dolan Springs, and approximately seven miles east of Highway 66. The property is accessed from Highway 66 via White Hills Road, east approximately eight miles to the northwest corner of the subject property, and WHEREAS, review of Floodplain Map #040058-1600B indicates this area to be clear of a designated flood zone. The property is currently vacant, with the surrounding land uses consisting of single family residences to the east, south and west, and a subdivision land sales office to the north. The zoning surrounding this parcel consists of commercial property to the north, east and west, with R-1 (Single Family Residential) to the south, and WHEREAS, the applicant has requested A-R zoning for this parcel. To allow A-R zoning would constitute a spot zone and would also allow agricultural uses that would conform to the surrounding area, and WHEREAS, the initial request by the applicant was for A-R zoning. Staff feels this request would constitute a spot zone and is recommending a modification to R-1 zoning which is consistent with the surrounding properties. It is Staff's opinion that this zone change will not be inconsistent with the surrounding properties. The lots on the east and west currently have homes on the property under Zoning Use Permits to allow homes be located on commercial property. The property located directly south is zoned R-1. The Planning and Zoning Commission rejected Staff's recommendation for approval and denied the change of zone, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 14, 1993, the Commission recommended DENIAL of the requested change of zone with the applicant understanding and accepting the following conditions: 1. This request would constitute a down-zoning that would not be beneficial to the community. 2. Some community members were against the rezoning. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on June 26, 1993, and posted July 16, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 2, 1993, DENIED this change of zoning as recommended by the Mohave County Planning and zoning Commission and outlined herein with the following condition: That the Mohave County Planning and Zoning staff suspend all action on violations on Lot 531 until an application for a Zoning Use Permit is considered for Lot 522 and that the fee for the Zoning Use Permit be waived.
