RANCHES, FROM A-R/IOA (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE A-R/5A (AGRICULTURAL- RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN SECTION 5, TOWNSHIP 22 NORTH, RANGE 16 WEST, LOCATED APPROXIMATELY FOUR AND ONE-HALF (4.5) MILES NORTH OF NORTHERN AVENUE AND ONE-HALF (.5) MILE EAST OF NORTH BANK STREET IN THE LONG MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA. (!G;....~ ~_,..;.---,:;,1 .."":-} \~~i~/ WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 2, 1993, a public hearing was conducted to determine whether approval should be granted to Joseph and Nikki Thelen of San Diego, CA for a zone change from A-R/I0A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone to A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size) zone in the Long Mountain area, and WHEREAS, the subject property is wi thin the Long Mountain Area Plan. WHEREAS, access to the subject property is from Northern Avenue to North Bank Street north approximately four and one-half miles, thence east on Calle Dimas approximately one-half mile to the northwest corner of the site. WHEREAS, currently the site is without utilities. Existing utilities are approximately one mile to the north. The subject property is vacant and surrounding land uses consist primarily of vacant land with the exception of two distant residences. Site topography consists of rolling terrain covered with desert vegetation. There appears to be a minor wash running between the two most northerly proposed parcels. WHEREAS, review of Floodplain Map #040058-2155B indicates this parcel is in zone "C", an area of minimal flooding. WHEREAS, the applicant is requesting the granting of a 30- foot roadway easement with an offset 45-foot cul-de-sac for I~!~ access to the proposed parcels. Staff views the request as a P:) legitimate form of access and circulation. WHEREAS, this rezone is in conformance with the Long Mountain Area Plan. '" . . r, RESOLUTION NO. 93-225 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 14, 1993, the Commission recommended APPROVAL of the zone change and resultant lot split contingent on the following: 1. The three parcels be zoned A-R/5A Residential/Five Acre Minimum Lot Size) (Agricultural- zone. 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The three parcels will meet or exceed five acres exclusive of road easements or rights-of-way. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6 . ,..-~ t"" ~\) ~~.,.:~ That appropriate zoning/building/environmental permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The granting of a 3D-foot ingress/egress and public utility easement along the eastern property line extending south from Calle Dimas to an offset 90-foot diameter cul-de-sac terminus, with a 25-foot radius curve between the 3D-foot I/E and PUE and the cul-de- sac bulb and, a 20-foot radius curve at the northeast corner of the property. In addition the granting of an eight-foot public utility easement along the northern property line. This shall be approved through the recording of the resolution authorizing the zone change, and that the granting be shown via an acceptance statement and identified on the Parcel Plat. -~~ f~~;..cj. I_~ "'" ',~1 , ...,~. 8. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 9. I f these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to: grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification. This action is- in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. RESOLUTION NO. 93-225 Page 3 WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 26, 1993, and posted July 16, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 2, 1993, approved this zone change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
