RESOLUTION NO. 93-224 A RESOLUTION SETTING FORTH A REZONING OF PARCEL 510-A IN STOCKTON HILL RANCHES, UNIT 10, FROM A-R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE A-R/5A (AGRICULTURAL- RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN SECTION 18, TOWNSHIP 23 NORTH, RANGE 16 WEST, LOCATED APPROXIMATELY ONE-HALF (.5) MILE EAST OF STOCKTON HILL ROAD AND DIRECTLY NORTH OF CALLE CHAVEZ IN THE LONG MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 2, 1993, a public hearing was conducted to determine whether approval should be granted to Matthew and Karin Dolph of San Francisco, CA for a zone change from A-R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone to A-R/5A (Agricultural-Residential/Five Acre Minimum Lot Size) zone in the Long Mountain area, and WHEREAS, the subject property is within the Long Mountain Area Plan. Parcel S10-A is accessed from Jagerson Avenue to Stockton Hill Road, thence north approximately seven and one-half miles, thence east on Calle Chavez approximately one-quarter mile to the southwest corner of the subject property. WHEREAS, review of Floodplain Map #040058-2000B indicates this parcel is within zone "C", an area of minimal flooding. WHEREAS, the subject property is bounded on the east and west sides by roadway and utility easements. Currently, the property and surrounding land is vacant. Existing residences are few and scattered . Site topography consists of rolling terrain covered with desert vegetation. There, is a minor wash which appears to run along the northerly border of the subject property. WHEREAS, this rezone is in conformance with the Long Mountain Area Plan. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 14, 1993, the Commission recommended APPROVAL of the zone change and resultant lot split contingent on the following: ,i.e.. ;r." . . RESOLUTION NO. 93-224 Page 2 '. -J l. . .~ ,-~' 1. The three parcels be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The three parcels will meet or exceed five acres exclusive of road easements and rights-of-way. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6. That appropriate zoning/building/environmental permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7 . The Board of Supervisors accept the following: the abandonment of the existing 30-and 60-foot roadways and utility easements as they are within and contiguous to the western and eastern boundaries of the subject property; the dedication of a 30-foot road right-of-way along the eastern boundaries, a 60-foot righ.t-of-way along the western boundary and two 20-foot radius curves to be at the southwest and southeast corners of the subject property. In addition, the granting of an eight-foot public utility easement along the western, southern and eastern boundaries of the subject property. This shall be approved through the recording of the resolution authorizing the zone change, and that the granting and dedication be shown via an acceptance statement on the Parcel Plat. i8~;;'~~ <.../ 8. That the abandonments, dedications and grantings be identified on the Parcel Plat. 9. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classific~tion, as per ARS 11-829E. I f these conditions are not met within one year this approval will be void. I f at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to: grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of "general circulation in Kingman, Mohave County, Arizona, June 26, 1993, and posted July 16, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 2, 1993, approved this (:cr:~~ zone change as recommended by the Mohave County Planning and \,~~: Zoning Commission and outlined herein.
