PAGE 1 OF 2 HOHAVE COUNTY BOARD OF SUPERVISORS RECOROI~G FEE 0.00 NC - RESOLUTION NO. 93-221 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ( ZUP ) FOR THE ESTABLISHMENT OF A PRIVATE AIRCRAFT LANDING STRIP, LOCATED IN AN A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, ON GOVERNMENT LOT 2, SECTION 23, TOWNSHIP 16~ NORTH, RANGE 18 WEST, LOCATED .APPROXIMATELY TWO (2) MILES EAST OF INTERSTATE 40 AND APPROXIMATELY FIVE (5) MILES SOUTH OF YUCCA TOWNSITE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY ARIZONA WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held August 2, 1993, a public hearing was conducted to determine whether approval should be granted to l'S>- Sergio Veikala of Los Angeles, California for a private air strip \."''o; in an A-R(36A (Agriculture-Residential(Thirty-siX Acre Minimum ~ Lot Size) zone, located south of Yucca Townsite. WHEREAS, Government Lot 2 is located approximately two miles east of 1-40 and approximately five miles south of Yucca Townsite. The property is accessed by 1-40 via the eastern frontage road (Alamo Road), thence southeast approximately three miles to Arizona Road, thence south approximately one mile to Oscar Drive, thence east approximately one-half mile to the northwest portion of the subject property, and WHEREAS, review of Floodplain Map #040058-2850B indicates this parcel to be clear of a designated floodplain. The property is currently vacant. Surrounding land uses consist primarily of vacant land with a few scattered residences. The property is 50 acres in size, with surrounding parcels to the east, south and west also being 40 acres or greater. The area to the north has been subdivided into two and one-half acre parcels. The applicant desires to obtain a zoning Use Permit to have a private landing strip on the property, and WHEREAS, the Planning and zoning Department recommended denial of this zoning Use Permit based on the Mohave County zoning Ordinance which does not have a provision for private air strips in an A-R zone, and that this type of use is inconsistent with the surrounding residential properties. The County Attorney's Office has stated "Under the circumstances, the Board of Supervisors could allow a 'private aircraft landing strip' in ;~:~;?~~1 , j '.....~ ......)-' . . ';'""..... ~ ;",.;ii RESOLUTION NO. 93-221 page 2 an A-R zone, but only if the Board determined that the use was deemed essential or desirable to the public convenience or welfare, and [is] in harmony with the various elements of objectives of the General Plan". (See Section 27(A) of the Mohave County Zoning Ordinance.) The Planning and zoning Commission rejected Staff's recommendation for denial and approved the zoning Use Permit for a private air strip, and WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on July 14, 1993, the Commission recommended APPROVAL of the requested Zoning Use Permit with the applicant understanding and accepting the following conditions: 1. The applicant c?mply with all applicable provisions of the Mohave County zoning Regulations, and compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. That appropriate zoning/building/environmental permits be obtained. 3. If construction or use has not commenced within one year of Board approval of the zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 4. This zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, on June 26, 1993, and posted July 16, 1993 as required by Arizona Revised Statutes, and the Mohave County zoning Regulations. ~~'~ .........., ^'-.:_-::i~.
