PAGE 1 OF 3 ~OHAVE CO~~TY BOARD Qf SUPERVISORS RECOROIf,G FEE a.ao HC A RESOLUTION SETTING FORTH A REZONING OF THE SOUTHEASTERLY 1124 FEET, EXCEPT THE NORTHEASTERLY 724 FEET, OF PARCEL 3S-A OF PEACOCK MOUNTAIN RANCHES, FROM A-R/I0A (AGRICtJLTURAL- RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE A- R/4A (AGRICULTURAL-RESIDE~TIAL/FOUR ACRE MINIMUM LOT SIZE) ZONE, IN SECTION 7, TOWNSHIP 21 NORTH, RANGE 15 WEST, LOCATED APPROXIMATELY TWO (2) MILES EAST OF THE KINGMAN CITY LIMITS AND APPROXIMATELY ONE (1) MILE NORTH OF INTERSTATE 40 IN THE MORAVE COUNTY GENERAL AREA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 2, 1993, a public hearing was conducted to determine whether approval should, be granted to Therese o. Francois of San Diego, CA for a zone change from A- R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone to A-R/4A (Agricultural-Residential/Four Acre Minimum Lot Siz,e) zone in the Mohave County general area, and WHEREAS, the subject property is located approximately two miles east of the City of Kingman and approximately one and one- half miles north of Interstate 40. The property is accessed by Interstate 40 via D. W. Ranch Road, thence northwest on Roundup Avenue approximately one and three-quarter miles to the southeasterly corner of the property. WHEREAS, the subject property is bounded on the southwesterly and southeasterly sides by 70-foot rights-of-way, named Roundup Avenue and ,Taos Drive, respectively. There are no utilities serving this property. Surrounding land uses consist primarily of vacant land with six distant and widely scattered residences. Site topography is comprised of rolling terrain. The rear portions of the proposed parcels are bisected by a wash. WHEREAS, Floodplain Map #040058-2350C indicates ,this parcel is within a zone "C" designation, an area of minimal. flooding, which does not require a permit. WHEREAS, the subject property is not within, the building overlay zone or a designated area plan. The adjacent parcel bounding the subject property' s northeasterlr side was recently rezoned to A-R/4A (Agricultural-Residential/Four Acre Minimum) per BOS Resolution No. 93-136. ~-) .....~~ _ ,J . . RESOLUTION NO. 93-219 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on July 14, 1993, the Commission recommended APPROVAL of the zone change and resultant lot split contingent on the following: 1. The three parcels be zoned A-R/4A (Agricultural- Residential/Four Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The three parcels will meet or exceed four acres exclusive of roa~ easements or rights-of-way. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6. That appropriate zoning/building/environmental permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The Board of Supervisors accept the dedication of a 20- foot radius curve at the north corner of the Roundup Avenue and Taos Drive intersection and grant an eight- foot public utility easement where the subject property fronts Roundup Avenue and Taos Drive. This shall be approved through the recording of the resolution authorizing the zone change, and that the granting and dedication be shown via an acceptance statement on the Parcel Plat. 8. The dedication and granting be identified on the Parcel Plat. 9. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 10. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to: grant an extension, determine compliance with the schedule for development or cause PAGE 2 OF 3 BK 2261 PG 606 (FEE~93-44049) '..J _.J- -~ . . Arizona Revised 6, 11-832. to revert to its former zoning This action is in accordance with Statutes Annotated, Title 11, Chapter WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 26, 1993, and posted July 16, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 2, 1993, approved this zone change as recommend,ed by the Mohave County Planning and Zoning Commission and outlined herein.
