PAGE i OF 2 HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 Nt IIICROfILUED RESOLUTION NO. 93-211 A RESOLUTION SETTING FORTH APPROVAL OF AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN OF CASA DEL SOL, TRACT 4107, BEING THE NE~ OF THE NW~ SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 2, 1993, a public hearing was conducted to determine the approval of an Extension of Time for CASA DEL SOL, Tract 4107, and WHEREAS, the owner/developer of this tract is Joy Lane 40 Limited Partnership, Scottsdale, Arizona. The engineer responsible for the preparation of the drainage report and design of this subdivision is Jack Stovall, P. E., Stovall Engineers, Inc.; Bullhead City, Arizona, and WHEREAS, this project is located three-quarter mile east of Highway 95 on the south side of Joy Lane, and WHEREAS, this proposed subdivision consists of 40 acres subdivided into 127 lots with a maximum lot size of 9,000 square feet and a minimum lot size of 5,000 square feet with a density of 3.17 lots per acre. Tract 4107 lies within a designated floodplain A Zone, and WHEREAS, in the letter dated April 27, 1993, received by Planning and Zoning on April 29, 1993, Mr. Jim Blakemore, Jr., representative of the owner/developer, states, "There have been a number of delays in preparing this project for the Final Plat submittal, including economic setbacks of which have included sewer line hookups. We are actively working on coming to an economic solution in resolving these problems," and WHEREAS, Article 3.10 states, "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated," and . :~ . . RESOLUTION NO. 93-211 Page 2 i , WHEREAS, the Preliminary Subdivision Plan was approved by the Mohave County Board of Supervisors on July 2, 1990 via Resolution No. 90-167. The first Extension of Time was granted via Resolution No. 92-288. This will be the second Extension of Time, and WHEREAS, at the public hearing before the Mohave County Planning Commission on July 14, 1993, the Commission recommended conditional approval of the requested Extension of Time with the applicant understanding and accepting the following conditions: 1. Compliance with all conditions as stated in BOS Resolution No. 90-167. 2. This Extension of Time will be in effect until July 2, 1994. NOW THEREFORE BE IT RESOLVED, that notice of hearing has been met and published throughout this subdivision process as required by Arizona Revised Statutes and Mohave County Regulations, and the public was afforded notice of this action through advertisement of the Board of Supervisors meeting for this date. "i,_...- NOW THEREFORE BE IT, FURTHER RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 2, 1993, approved this Extension of Time for the Preliminary plan of CASA DEL SOL, Tract. 4107, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
