PAGE i OF 2 HOHAVE COUNTY BDARD OF SUPERVISORS RECORDING fEE D.OO Ne I1QtOflI.MiD RESOLUTION NO. 93-210 A RESOLUTION SETTING FORTH APPROVAL OF AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN OF COPPER CREEK RANCH, TRACT 4112, BEING A PORTION OF SECTION 6, TOWNSHIP 18 NORTH, RANGE 21 WEST, LOCATED IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 2, 1993, a public hearing was conducted to determine the approval of an Extension of Time for COPPER CREEK RANCH, Tract 4112, and WHEREAS, the owner/developer of this tract is Aaron M. Stover, dba Russell Partners, Lake Havasu City, Arizona. The engineer responsible for the preparation of the drainage report and design of this subdivision is South pointe Consultants, Bullhead City, Arizona, and WHEREAS, this project is located two and one-half miles west of Highway 95 on Boundary Cone Road, and WHEREAS, this proposed subdivision consists of 357 acres proposed to be developed into an 18-hole golf course, 642 single family residential lots, and a parcel that will house the Clubhouse with associated parking, a driving range, and community facilities complex, and WHEREAS, in the letter dated May 4, 1993, received by Planning and Zoning on May 5, 1993, Mr. Lee E. Bruno, representative of the owner/developer, states, "To our knowledge and belief there has been no change in conditions. please accept this letter as written application for a one year Extension of Time. "Regarding our plan, the partners still intend to proceed with the subdivision, but progress is hampered because of the continued lack of available financing for raw land. Even though the partners own the property free of any liens or obligations, the present banking philosophy is to avoid any purely land development financing. We believe that when the real estate market in the Mohave Valley rebounds, lenders will take a more favorable attitude toward development financing, and we will then be able to proceed," and r-'" . . RESOLUTION NO. 93-210 Page 2 WHEREAS, Article 3.10 states, "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated," and WHEREAS, the Preliminary Subdivision Plan was approved by the Mohave County Board of Supervisors on July 23, 1990 via Resolution No. 90-191. On July 6, 1993 a first Extension of Time was granted by the Mohave County Board of Supervisors via Resolution No. 92-230. This will be the second Extension of Time, and WHEREAS, at the public hearing before the Mohave County Planning Commission on July 14, 1993, the Commission recommended conditional approval of the requested Extension of Time with the applicant understanding and accepting the following conditions: 1. Compliance with all conditions as stated in BOS Resolution No. 90-191. 2. This Extension of Time will be in effect until July 23, 1994. NOW THEREFORE BE IT RESOLVED, that notice of hearing has been met and published throughout this subdivision process as required by Arizona Revised Statutes and Mohave County Regulations, and the public was afforded notice of this action through advertisement of the Board of Supervisors meeting for this date. NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 2, 1993, approved this Extension of Time for the Preliminary Plan of COPPER CREEK, Tract 4112, as recommended by the Mohave County Planning and zoning Commission and outlined herein. ~~COUNTY BOARD OF SUPERVISORS S sdnd1t-~~an . . #v PAGE 2 OF 2 BK 2261 PG 585 (FEE~93-~~039)
