RESOLUTION NO. 93-167 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A WATER BOTTLING FACILITY IN AN A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, ON A PORTION OF PARCEL 5, FORT ROCK RANCHES UNIT 1-B, SECTIONS 7 & 8, TOWNSHIP 20 NORTH, RANGE 11 WEST, LOCATED IN THE MOHAVE COUNTY GENERAL AREA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 7, 1993, a public hearing was conducted to determine whether approval should be granted to Ronald J. Clark of Aquatius Water Co., Tucson, Arizona, for an extension of time for a Zoning Use Permit in an A-R/36A (Agricultural-Residential/Thirty Six Acre Minimum Lot Size) zone, for the establishment of a Water Bottling Facility, and WHEREAS, Sections 7 & 8 are located approximately thirty (30) miles east of Kingman and approximately three ( 3) miles south of I-40. Access from I-40 is via the Knight Creek Interchange, thence south along a number of unnamed county roads to the subject property, and WHEREAS, review of floodplain map #040058-2425B indicates this area to be clear of a designated flood zone. Surrounding land uses consist of mostly vacant land with some homes dispersed in a very low density pattern, mainly ranch houses for the agricultural and ranching concerns in the area, and WHEREAS, the applicant desires to establish a water bottling facility on a newly created forty-plus (40+) acre parcel. The facility will consist of a "clean room" in which the water will be bottled then shipped to the Kingman area for further processing and shipping. The applicant has indicated that the water must be bottled on site and cannot be shipped in large containers to another facility. This condition is part of the requirements of the "Fair Packaging and Labeling Act" and is part of the water bottling regulations administered by the Food and Drug Administration (FDA), and WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of Supervisors on March 9, 1992, per Resolution Number 92-69, to Aquaris Water Company of Lake Havasu City, Arizona, and RESOLUTION NO. 93 -167 PAGE 2 WHEREAS, the applicant has requested an extension of time for one year, so they may have the opportunity to complete the project. This will be the first extension of time for this rezoning, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 12, 1993, the Commission recommended APPROVAL of the extension of time for a Zoning Use Permit contingent upon the following: 1. Continued compliance with conditions of Resolution No. 92 -69. 2. A site plan in accordance with Section 27.P, prior to submittal of Building Permits. 3. This extension of time be granted for one year, being March 9, 1994. WHEREAS, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 22, 1993, and posted May .21, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday June 7, 1993, approved this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
