RESOLUTION NO. 93-164
A RESOLUTION SETTING FORTH A ZONING USE PERMIT FOR THE
ESTABLISHMENT OF A RETAIL PLANT NURSERY IN A C-2 (GENERAL
COMMERCIAL) ZONE, LOCATED ON THE NORTHWEST CORNER OF HIGHWAY 66
AND DIAGONAL WAY, SECTION 33, TOWNSHIP 22 NORTH, RANGE 16 WEST,
IN THE KINGMAN AREA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 7, 1993, a public hearing was
conducted to determine whether approval should be granted to Judy
A. Mortensen of Mesa, Arizona, for a Zoning Use Permit for a
Retail Plant Nursery in a C-2 (General Commercial) zone, in the
Kingman Area, and
WHEREAS, the property is
Diagonal Way, approximately one
Kingman's northern city limits.

The property is accessed from
WHEREAS, review of floodplain map #040058-2165C indicates
this property to be clear of a designated floodplain. The
property is currently vacant, with a mobile home located to the
northwest and another home located across Diagonal Way, and
vacant land to the north and south. The surrounding land uses
consist mainly of single family homes to the west, and scattered
commercial businesses along Highway 66, and
WHEREAS, the applicant intends to use the property for a
retail plant nursery, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 12, 1993, the Commission
recommended Approval of the requested Zoning Use Permit
contingent upon the following:
1. The applicant comply with all applicable provlslons of
the Mohave County Zoning Regulations, and compliance
with Section 27.P (Site Plan Requirements), Section 27.L
(Retail Plant Nurseries) and Ordinance 87 -1 (Dark Sky
Ordinance) is also required.

2. That appropriate zoning/building/environmental permits
be obtained.
3. If construction or use has not commenced within one (1)
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six (6) months, then
approval shall terminate at that date.
4. This zoning Use Permit is subject to revocation upon
sixty (60) days notification by the Board of Supervisors
if, in the opinion of the Commission and Board, the
continued use of the property would be contrary to the
public health, safety, and welfare.
WHEREAS, the notice of hearing was published in the Kingman
Standard, a newspaper of general circulation in Kingman, Mohave
County, Arizona, May 22, 1993, and posted May 21, 1993 as
required by Arizona Revised Statutes, and the Mohave County
Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday June 7, 1993, approved this
Zoning Use Permit as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
