RESOLUTION NO. 93-154
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED
PRELIMINARY PLAN FOR MOUNTAINSIDE RANCH, TRACT 4106, BEING A
PORTION OF SECTION 6, TOWNSHIP 18 NORTH, RANGE 21 WEST, LOCATED
IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on June 7, 1993, a public hearing was
conducted to determine the approval of the Extension of Time for
MOUNTAINSIDE RANCH, TRACT 4106, and
WHEREAS, the owner/developer of this tract is Homes by Dave
Brown, Tempe, Arizona. The engineer responsible for the
preparation of the drainage report and design of this subdivision
~~ is Holland West, Inc., Bullhead City, Arizona, and

WHEREAS, this project is located on the northeast corner of
Boundary Cone Road and Bison Road. Parcel "C," which is located
on the south side of Boundary Cone' Road, is proposed for
Multifamily and Commencial, and
WHEREAS, this proposed subdivision consists of two hundred
six (206) acres with 1004 single family units and commercial
development, and
WHEREAS, the preliminary plan for this tract was approved by
the Mohave County Board of Supervisors on May 5, 1990, via BOS
Resolution 90-113. A final plat of Mountainside Ranch, Tract No.
4106-A, was conditionally approved by the Board of Supervisors on
September 17, 1990 and recorded December 18, 1990. A final plat
of Tract No. 4106-B was conditionally approved by the Board of
Supervisors December 17, 1990 and has not recorded. A final plat
of Tract No. 4106-C was conditionally approved by the Board of
Supervisors on December 17, 1990 and has not been recorded. A
final plat of Tract No. 4106-D has not received final plat
approval. Board of Supervisors Resolution No. 92-140 approved a
mobile home as a sales office in an A-R (Agricultural-
Residential) zone on May 4, 1992. Board of Supervisors
Resolution No. 92-143 extended the approved preliminary plan to
May 4, 1992. This would be the second extension of time, and

WHEREAS, on August 21, 1992, the Board of Supervisors
approved an abandonment and a reversion of acreage via BOS
Resolutions 92-252 and 253. The actions basically removed all
recorded information concerning Tract 4106-A from the county
recorder~s and assessor~s files. The abandonment/reversion, once
approved, essentially returned this tract to an approved final
stage. In fact, Condition #1 in Resolution 92-252 states, "That
the tract remain an approved final as set forth in the Board of
Supervisors Resolution No. 90-254". Condition #8 of the same
resolution states, "It is further understood that the continued
perpetuation of the final maps based on approved preliminary plat
4106, Board of Supervisors Resolution No. 90-113, depend on
requesting and receiving extensions of time for that approved
preliminary, as required by the Mohave County Subdivision
Regulations" . It should be noted that if the final for Tract
4106-A is requested to be recorded again, then all of the
conditions contained in BOS Resolution No. 90-254 would be
complied with. Moreover, several items that would have been in
place after the first phase was recorded would either not be
there or would have expired; i.e" water allocation from the
Mohave Valley Irrigation and Drainage District, and
WHEREAS, the Planning Staff received an updated preliminary
phasing plan on February 6, 1992. This plan has seven (7)
phases, contains discrepancies and omissions, and
WHEREAS, in the letter dated April 6, 1993, received by
Planning and Zoning on April 8, 1993, Mr. Robert W. Gawley, Vice
President of Land Development, requested an extension of time for
the conditionally approved preliminary plan.' The reason given
for the extension request was a slow down in the real estate
sales market over the past two (2) years.
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on May 12, 1993, the Commission
recommended APPROVAL of the requested extension of time with the
applicant understanding and accepting the following conditions:
1. That Resolution Number 92-140 approval of a zone use
permit allowing the use of a mobile home as a sales
office in an A-R (Agricultural-Residential) zone be
rescinded, since that portion of the subdivision in
which sales would have taken place has now been
abandoned and reverted to acreage.
2. Compliance with all conditions as stated in BOS
Resolution P&ZC 90-113.
3.
This extension of time will be in effect until June 7,
1994.

NOW THEREFORE BE IT RESOLVED, the notice of hearing has been
met and published throughout this subdivision process and the
public was afforded notice of this action through advertisement
of the Board of Supervisor's meeting for this date as required by
Arizona Statutes and Mohave County Regulations.
NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of
Supervisors, at their regular meeting on Monday, June 7, 1993,
approved the granting of this extension of time for the approved
preliminary plan as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
