PAGE 1 OF 3 NOHAVE COUNTY BOARO OF SUPERVISORS REt~RDING FEE 0.00 He RESOLUTION NO. 93-369 A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 93- 233, WHICH REZONED PARCEL 39 OF ZAFIRO ACRES, SECTION 5, TOWNSHIP ~. 22 NORTH, RANGE 16 WEST, FROM A-R/10A (AGRICULTURAL- RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE LONG MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. f1~ !'~>';) \.~ I. I~"?;; WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1993, a public hearing was conducted to determine whether approval should be granted for an amendment to BOS Resolution No. 93-233 on a portion of the above described property to SMK Limited Partnership, general partners Roger and Elizabeth Sayles, of Kingman, Arizona, and WHEREAS, the proposed amendment changes condition number seven of rezone approval. Roger and Elizabeth Sayles are requesting that the granting of the 30-foot ingress/egress and public utility easement be along the west side of their property as opposed to the east side as stated in the condition of approval. Access along the west side was their original intent. The error was committed by staff and discovered during the Parcel Plat process, and WHEREAS, the proposed amendment will not change staff~s recommendation of approval for the zone change, nor will any planning activity in the Long Mountain area be effected by this decision, and WHEREAS, the following is the wording from the original recommendation: "The subject property is within the Long Mountain Area Plan. It is located in the northeast quarter of Section 5, approximately three and one-half miles north of Jagerson Street. Parcel 39 is accessed from Jagerson to North Bank Street approximately three and one-half miles north, thence east on Calle Alamo approximately one-half mile to the northwest corner of the subject property, and .., ... There are two residences within an approximate one-half mile radius; the remaining land in the vicinity and the subject property are vacant. Site topography is relatively flat with typical desert vegetation, and "Floodplain Map #0400S8-21SSC indicates this parcel is within a zone "C" designation, an area of minimal flooding, and "The applicant desires this 16. 6-acre parcel to be split into three S-plus acre parcels. Site access is off Calle Alamo, an east-west arterial for the Long Mountain area, via a proposed 30-foot private road and utility easement along the western property line of the two most northern proposed parcels, and "This rezone is in conformance with the Long Mountain Area Plan.", and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 10, 1993, the Commission recommended APPROVAL for a Resolution Amendment subject to the following, with the old language struck and the new langUage BOLDED: 1. The three parcels be zoned A-R/SA (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The three parcels will meet or exceed five acres exclusive of road easements or rights-of-way. 4. Each parcel shall have legal access. S. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6 . That appropriate zoning/building/environmental permits be obtained prior to any development. The granting of a 3D-foot ingress/egress and public utility easement along the ~ west side of the proposed two most northern parcels. This shall be approved through the recording of the resolution authorizing the zone change, and that the granting be shown via an acceptance statement and identified on the Parcel Plat. 8. The rezone shall not become effective for 3D days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. .~ 9 . If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to: grant an extension, determine compliance with the ,schedule for development or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. r?:r~ \i-:;j,;; WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 21, 1993, and posted November I 19, 1993, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1993, APPROVED this Resolution Amendment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
