PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDIMG FEE 0.00 Ne . 1I1CROflLMED RESOLUTION NO. 93-367 A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 92- 117, WHICH REZONED PARCEL 38 OF LAZY Y-U RANCH, PHASE I, SECTION 11, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM A-R/36A (AGRICULTURAL- RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/9A AND A-R/19A (AGRICULTURAL-RESIDENTIAL/NINE ACRE AND NINETEEN ACRE MINIMUM LOT SIZES) ZONE, LOCATED IN THE HUALAPAI MOUNTAIN PORTION OF THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1993, a public hearing was conducted to determine whether approval should be granted for an amendment to BOS Resolution No. 92-117 on a portion of the above described property to owner Gary J. Lacaze, General Partner with Baltic Enterprises of Kingman, Arizona, and f:";;;:":.. \' . ""; WHEREAS, the proposed amendment changes the zoning v;:?J:;o-'>" designation from A-R/19A to A-R/17A thereby allowing Parcel 38A, which has a net 17.587 acres, to be brought into zoning conformance by meeting an amended lot size requirement, and .. ., !~" f:'!i."'" ", WHEREAS, the following is the wording from the original recommendation: "The subject property is located approximately four (4 ) miles southeast of the Kingman City Limits, on Hualapai Mountain Road. The subject property is approximately two and one-half (2.5) miles southwest of Hualapai Mountain Road and is accessed via Lazy Y-U Drive, Pack Saddle Drive and Stallion Lane. An internal road easement will provide access to the new parcels, and "Review of floodplain map '2350-3450 indicates this area to be within Flood Zone C (area of minimal flooding). The terrain is rugged mountain foothill country. Well constructed gravel base roads serve these properties. The site is currently vacant and bordered on all sides by vacant land. The property is currently zoned A-R/36. PAGE a" :.:r, 20F 232& F6 "3 7~O (FEE~93-71519) RESOLUTION NO. 93-367 Page 2 "Lazy Y-U Ranch, Phase I is the division of three (3) Sections plus eighty (80) acres, into fifty (50) parcels of forty (40) acres or more each. The developers plan to divide an additional six (6) Sections of land in the future, and "All roads are easements and as such do not create parcel divisions, according to the state Real Estate office. The road designation is designated as follows: "easements shown...are perpetual in nature and are created for ingress/egress, drainage and public utility purposes for the benefit of each of the parcels and their owners and the public". The project attorneys recommended this wording to accommodate the public, and "There is no specific Area Plan for this area, and it is not within the Mohave County Building Overlay area.", and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on November 10, 1993, the Commission recommended APPROVAL for a Resolution Amendment based on the following, with the old language struck and the new language BOLDED: 1. Two parcels are to be zoned A-R/9A (Agricultural- Residential/Nine Acre Minimum Lot Size) and one parcel be zoned h R/19~ (hgricultur31 Reaidenti31/Nineteen ~cre Minimum Lot Size) A-R/17A (Agrieultural- Residential/Seventeen Acre Minimum Lot Size) zone. 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. Each parcel shall have legal access. 4. Any new ingress/egress easements shall also be Public Utility Easements. 5. The Parcel Plat shall show any surface drainage and the FEMA flood zones. 6. No building/zoning permits shall be issued until after Parcel Plat recordation. 7. I f these conditions are not met within one (1) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board, after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 21, 1993, and posted November 19, 1993, as required by Arizona Revised Statutes and the Mohave County zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their - regular meeting on Monday, December 6, 1993, APPROVED this Resolution Amendment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
