'.;~'- , /."-, - - ~.~(~:~'~2:>~~;" RESOLUTION NO. 93-359 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY PLAN OF AZTEC JUNCTION, TRACT 3019, BEING A SUBDIVISION OF PARCEL 46 AND A PORTION OF PARCEL 47, PER THE RECORD OF SURVEY MAP FOR SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST, LOCATED IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1994, a public hearing was conducted to determine the approval of an Extension of Time for the approved Preliminary Plan of AZTEC JUNCTION, Tract 3019, and WHEREAS, the owner/developer of this tract is Aztec Junction One Limited Partnership, Jim Kuden, General Partner, of Escondido, California, and WHEREAS, the Preliminary plan depicts 51 acres subdivided ,.:;.:.;/- into 153 lots. Of the 153 lots, the three lots fronting on Highway 68 range in size from 1.15 to 4.3 acres and are proposed to be zoned C-2 (General Commercial). The remainder of the tract, or 38.4 acres, is proposed to be subdivided into 150 residential lots. The lots range in size from 6,000 square feet to 10,00 square feet, yielding a density of 3.9 lots per acre, and WHEREAS, Article 3.10-1 of the Mohave County Subdivision Regulations states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated," and WHEREAS, the Preliminary Plan for this subdivision was approved by the Mohave County Board of Supervisors on October 3, 1988, via Resolution No. 88-149. Phase "A" was submitted but was never recorded, and --"", .. . . PAGE 2 OF 6 BK 2351 PG 805 (FEE~9+- 6860) RESOLUTION NO. 93-359 Page 2 WHEREAS, the first Extension of Time was granted on March 4, 1991, via Resolution No. 91-78. The second Extension of Time was granted on October 21, 1991, via Resolution No. 91-236. That Extension of Time expired October 3, 1992. The third Extension of Time was granted via Resolution No. 92-392, and expires October 3, 1993. This will be the fourth Extension of Time for this project, and WHEREAS, in a letter Ruden, owner/developer of statement: dated Aztec September Junction, 23, made 1993, Mr. Jim the following "Last year when we requested a~ extension of time we pointed out that economic conditions in Mojave County, specifically the Golden Valley area, precluded our going ahead with any development on Tract 3019 subdivision at that time. We further pointed out that banks were not loaning money for projects in the subdivision category at that time. We further pointed out that builders who may have had borrowing ability in 1992 were concentrating their efforts in areas that had a quicker turn around time than Golden Valley offered. "From the time of our last letter to this one, I have not seen much change in the Mojave County employment structure. In addition, the economy and banking regulations, rules, and lending circumstances make it more profitable for banks to lend depositors money to the government through the purchase of bonds instead of loaning to the private sector for development. "Please believe me, I don't like what is happening any more than the Board does, but I cannot see spending money on a project at this time that would under present circumstances be impractical to construct for resale. "Until banking regulations are changed for the benefit of the private sector, which could happen in 1994, we must ask that you grant us another extension of time with Tract No. 3019.", and WHEREAS, in a letter dated October 19, 1993, Mr. Harold Ganyo, Mohave County Engineer, indicates no objection to the Extension of Time conditional upon the submission of updated Cost Estimates for Tract 3019, Phase "A", and WHEREAS, at the public hearing before the Mohave County Planning Commission on November 10, 1993, the commission recommended conditional approval of the requested Extension of Time subject to the following conditions: . e PAGE 3 OF 6 BK 2351 PG 806 (FEE~94- 6860) RESOLUTION NO. 93-359 Page 3 1. Compliance with all conditions as stated in BOS Resolution No. 88-149. 2. This Extension of Time will be in effect until October 3, 1994. WHEREAS, that the notice of hearing has been published throughout this subdivision process as required by Arizona Revised Statutes and Mohave County Regulations, and the public was afforded notice of this action through advertisement of the Board of Supervisors meeting for t~is date. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, February 1, 1994, APPROVED this Extension of Time for the Preliminary Plan of Aztec Junction, Tract 3019, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
