A RESOLUTION SETTING FORTH A REZONE OF LOT 21, RIO PALMAS UNIT
2B, SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM A-R
.~ (AGRICULTURAL-RESIDENTIAL) ZONE TO R-E (RESIDENTIAL-RECREATION)
ZONE, LOCATED IN THE SOUTH MOllAVE VALLEY AREA, MOllAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on December 6, 1993, a public hearing was
conducted to determine whether approval should be granted for a
zone change for the above described property to owners Jerrald
and Gloria Downie of Burbank, California, and
WlIEREAS, the subject property is located one-half mile south
of Bullhead City and east of Highway 95. The property is
f~;::;~ accessed from Highway 95 by Schiffer Road, then east to the
';~L_:;';::' subject property, and
WlIEREAS, there are two full-size mobile homes on the
property. The surrounding area consists of single family
residences and vacant land. The zoning for this property and
surrounding lots is A-R, one-acre minimum lot size, and
..
WHEREAS, review of Floodplain Map #040058-24350 indicates
this parcel to be in Zone A, an area of 100-year flood, base
flood elevations and flood hazard factors not determined. This
area requires a Floodplain Use Permit for any development, and
WHEREAS, A-R zoning allows one dwelling unit per one acre of
land. There are two mobile homes on the property which is a
violation of the Mohave County Zoning Ordinance, and
WHEREAS, this area is within the South Mohave Area Plan
boundary. The area plan indicates this area to be A-R (Low
Density Residential). Any requested change that does not conform
to the A-R designation would require an area plan amendment, and

WHEREAS, the Planning and Zoning staff uses area plans as
guides to help direct growth and development in the County. Zone
changes without amending the area plan limits the ability of
" staff to properly plan the future needs of the county, limits
.~i.~ community input and concern, and overrides policies approved by
c..:! the Planning and zoning Commission and the Board of Supervisors,

wHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on November 10, 1993, the
Commission recommended DENIAL for a zone change based on the
following:
1. The area plan indicates this area to be A-R, and the
plan has not been amended.
2.
This zone change would not be consistent with the
surrounding properties.
3. This change would set a precedent that would encourage
more than one dwelling unit per acre, changes without
amending area plans.
WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, November 21, 1993, and posted November
19, 1993, as required by Arizona Revised Statutes and the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, December 6, 1993, DENIED this
zone change as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
