FEE 0.00 He RESOLUTION NO. 93-356 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY PLAN OF MOHAVE VALLEY MALL, TRACT 4118, BEING A SUBDIVISION OF THE NE~ OF SECTION 22, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1993, a public hearing was conducted to determine the approval of an Extension of Time for the approved Preliminary Plan of MOHAVE VALLEY MALL, Tract 4118, and WHEREAS, the owner/developer of this tract is Mohave Valley Associates, Scottsdale, Arizona. The engineer responsible for the preparation of the drainage report and the design of this subdivision is Stovall Engineers, Inc., Bullhead City, Arizona, and WHEREAS, the preliminary plan depicts 42 into 8 lots, ranging in size from 2.5 to dedications are accepted and recorded, and acres subdivided 7.5 acres after WHEREAS, Article 3.10-1 of the Mohave County Subdivision Regulations states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated," and WHEREAS, the Preliminary Plan for this subdivision was approved by the Mohave County Board of Supervisors on December 3, 1990, via Resolution No. 90-374. A first Extension of Time was granted on October 14, 1992, via Resolution No. 92-348. This will be the second Extension of Time, and t. -,,"" '" ,.. RESOLUTION NO. 93-356 PAGE 2 OF 2 BK 2326 PG 726 (FEE~93-71S10) Page 2 WHEREAS, in a letter dated September 24, 1993, G. Kelly Grier, Stovall Engineers, Inc., representing Rena Sherman, owner and controlling interest of Mohave Valley Mall Associates, Ltd., made the following statement: "On behalf of our client, Rena Sherman, I respectfully request that the Mohave County Planning and Zoning Commission recommend an extension of time for Mohave Valley Mall, Tract 4118, in order to enable the continuation of the submittal and review process for the Final Plat. A cheque in the amount of $300.00 is enclosed for the County Application fee. "An E~tension of Time is needed due to a change in ownership, as well as legal complications," and WHEREAS, at the public hearing before the Mohave County Planning Commission on November 10, 1993, the Commission recommended conditional approval of the requested Extension of Time subject to the following conditions: 1. Compliance with all conditlons as stated in BOS Resolution No. 90-374. 2. This Extension of Time will be in effect until December 3, 1994. WHEREAS, that the notice of hearing has been published throughout this subdivision process as required by Arizona Revised Statutes and Mohave County Regulations, and the public was afforded notice of this action through advertisement of the Board of Supervisors meeting for this date. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1993, APPROVED this Extension of Time for the Preliminary Plan of Mohave Valley Mall, Tract 4118, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
