PAGE 1 OF 4 nOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He <<:~.. ,. %l'..~ RESOLUTION NO. 93-331 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF PARCEL "A", NEW KINGMAN ADDITION UNIT 11, IN THE NE~ OF SECTION 30, TOWNSHIP 22 NORTH, RANGE 16 WEST, TO BE KNOWN AS BLOCKS 2 AND 3 OF THE PROPOSED ALSTON CERBAT RIDGE SUBDIVISION, TRACT 3046, FROM S-D/C- 2 (SPECIAL DEVELOPMENT/GENERAL COMMERCIAL) ZONE TO R-O (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED) ZONE, LOCATED IN THE KINGMAN AREA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held November 1, 1993, a public hearing was conducted to determine, whether approval should be granted to rezone the above referenced property from S-D/C-2 (Special Development/General Commercial) zone to R-O (Single Family Residential/Mobile Homes Prohibited) zone, and WHEREAS, the owner/subdivider of this tract is Alston Development, Inc., Kingman, Arizona. The engineer responsible for the preparation of the drainage report and design of the subdivision is Thomas H. Glenn, P.E., Kingman, Arizona, and WHEREAS, this property is located on the south side of Jagerson Avenue, south of Mohave Community College. The proposed subdivision is situated between North Van Nuys Street and North Bond Street. Access to the Multi-Family and Commercial .lots will be from Jagerson Avenue, as approved by the Mohave County Public Works Department. Access to the Single Family lots will be from Carver and McVicar Avenues which will be extended through the subdivision, and WHEREAS, review of FEMA Floodplain Map #040058-2165C indicates that this 'proposed subdivision lies within Zone B, a minor designated flood zone. A 70-foot wide PUE and drainage channel which runs along the south side of the proposed subdivision is an A (major designated) flood zone, and . WHEREAS, the proposed subdivision is located on land which is a defunct drive-in movie theater. Surrounding land uses include Commercial along Jagerson to the north (Mohave Community College), and Single Family Residential to the south, east and _ west, and A. " '":' .. . .. . . RESOLUTION NO. 93-331 Page 2 PAGE 2 OF 4 BK 2305 PG 677 (FEEt93-6280~} WHEREAS, the developer is proposing to subdivide 13.35 acres into 32 lots consisting of one Commercial lot at 95,044 square feet, one Multi-Family Residential lot at 95,044 square feet, and 30 Single Family Residential lots ranging in size from 9,540 square feet to 10,654 square feet, and WHEREAS, the developer intends electric power, telephone, and gas to be provided by Citizens Utilities Company; domestic water by the City of Kingman; sewage treatment by on-site septic systems; and solid waste disposal by private carrier to the Mohave County Landfill. Hualapai Valley Fire Department will provide fire protection, and WHEREAS, this matter was continued from the May Planning and Zoning meeting due to the continuance of the approval of the Preliminary Subdivision Plan based upon concerns of P&Z members. The object of concern was the capability of Lots 1-10, Block 3, to support the construction of homes meeting setback requirements when a 50-foot setback for septic systems is required from the edge of the 70-foot wide PUE and drainage channel, and WHEREAS, the problem was discussed on May 25, 1993 with David Jefferson of the Mohave County Environmental Health Department. Mr. Jefferson verified that the lots meet the minimum standards for the installation of on-site septic systems. He did, however, state that all homes built on Lots 1-10, Block 3, must be built on the rear portion of the lot with the septic systems in the front yard. This placement is necessary in order to locate both home and septic system on the lot in compliance with the 50-foot required setback from the edge of the drainage channel which abuts the rear of the lots, and \ WHEREAS, on June 17, 1993, a letter from ADEQ, signed by Girish Desai, was received in the Planning and Zoning Office stating that the subdivision could not be approved as submitted. The letter listed three reasons for denial, and WHEREAS, on June 18, 1993, the developer and engineer were notified that this subdivision and related items were being pulled from the P&Z Agenda until ADEQ approval was obtained, and WHEREAS, on August 23, 1993, a Certificate of Approval of c Sanitary Facilities for the subdivision from ADEQ was hand- delivered by Chris Alston to Veryl Morrell of the Planning and Zoning Office. The certificate specified that each lot owner shall connect to the public sewer when it becomes available, and - ..A:." ~." ~ . . Compliance with the conditions stated on Preliminary Plat approval as set forth in Resolution No. 93-287. the BOS 3. The applicant shall comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County zoning Ordinance. Prior to the issuance of building permits a site plan must be submitted to, and approved by, the Mohave County Department of Public Works. This plan must show the layout of all proposed structures, interior roads or alleys, and access to Jagerson Avenue for the Commercial and Multi-Family Lots. 8. The rezone shall become effective upon the recordation of the Final Plat. If development is' phased, zoning shall become effective as each phase is developed. WHEREAS, the notice of hearing has been completed and published throughout this subdivision process as required by . Arizona Revised Statutes and Mohave County Regulations, and the public was afforded notice of this action through advertisement of the Board of S~pervisors meeting for this date.
