PAGE i OF 3 MOHAVE COU~TY BOARD OF SUPERVISORS RECORDI~G FEE 0.00 He ~1~ ....- .-' . p ~ '. ..; MJCRORlMED RESOLUTION NO. 93-326 A RESOLUTION SETTING FORTH A REZONE OF THE NORTH 892 FEET OF PARCEL 508, STOCKTON HILL RANCHES UNIT 10, FROM A-R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A- R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN SECTION 7, TOWNSHIP 23 NORTH, RANGE 16 WEST, IN THE LONG MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1993, a public hearing was conducted to determine whether approval should be granted for a zone change on the above described property to owner Phyllis Lambert of Arden Hills, Minnesota, and WHEREAS, the property is situated in the northern portion of the Long Mountain area. Access to the site is from Stockton Hill Road to Calle Salinas, then east approximately three-quarter mile to the site's northwest corner. Within the site ~ s western and eastern boundaries are 30-foot and 60-foot roadway and public utility easements, respectively, and WHEREAS, the site is vacant and no utilities are in place. The terrain is slightly rolling and covered by desert vegetation. The site slopes from west to east and is traversed by a small wash running in the same direction. Surrounding land uses are residential; however, the majority of the land is vacant with the exception of four distant dwellings, and WHEREAS, review of Floodplain Map #040058-2000B indicates this site is within Zone C, an area of mi~imal flooding, and WHEREAS, the site is within the Long Mountain Area Plan and the request for the zone change conforms with the Plan, and WHEREAS, at the public hearing before the Mohave County a Planning and zoning Commission on October 13, 1993, the Commission recommended APPROVAL of the zone change and resultant lot split subject to the following: . r.:y:" { ,.,,"..:.-:,,:, "... A. -:' ,~ .. .. a . ......- , . RESOLUTION NO. 93-326 Page 2 PAGE 2 OF 3 BK 2305 PG 67n (FEE~93-62802) 1. The two parcels be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The two parcels will meet or exceed five acres exclusive of road easements or rights-of-way. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The Board of Supervisors accept the dedication of a 60- foot roadway along the eastern boundary of the property, a 30-foot roadway along the western boundary, a 20-foot radius curve at the northeast corner of the property, and a 20-foot radius curve at the northwest corner of the property. In addition, the granting of an eight-foot public utility easement along the site's western, northern and eastern boundaries. This shall be approved through the recording of the resolution authorizing the zone change, and that the dedication be shown via an acceptance statement and identified on the Parcel Plat. 8. The dedications and granting be identified on the Parcel Plat. 9. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 10. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to: grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. A. "......~ . . ":' RESOLUTION NO. 93-326 Page 3 PAGE DV IJI\ 3 OF 2305 PG :5 671 (FEE;93-62802} WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 17, 1993, and posted October 14, 1993, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on November 1, 1993, approved this zone change as recommended by the Mohave County Planning and Zoning ~, Commission and outlined herein. .
