NORTH, RANGE 15 WEST, FROM RE (RESIDENTIAL RECREATION) ZONE TO RM/3A (MULTIPLE FAMILY RESIDENTIAL/THREE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE HUALAPAI MOUNTAIN PORTION OF THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. . f..~ .,..'. z:.'V. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1993, a public hearing was conducted to determine whether approval should be granted for a zone change for the above described property to owners Marvin and Margaret Moerbeck of Kingman, Arizona, and WHEREAS, the property is located approximately 13 miles southeast of the City of Kingman. The property is accessed from Kingman via Hualapai Mountain Road and lies at the end of this road in the Hualapai Mountains. The road narrows as it passes the fire ,station and ends at the property owner's gate. The road is paved up to said property line. The property can also be accessed from Hualapai Mountain Road via ponderosa Drive to the north side of the property. This road is currently dirt and is a dedicated County road, and WHEREAS, review of Floodplain Map #040058-2507B indicates this parcel is located in Zones A, an area of the 100-year floodplain, and C, an area of minimal flooding. The surrounding land uses consist of residences to the west with County park and BLM land to the east. The applicant owns the surrounding property directly east and south of the site. An area located west of this site is zoned C-RE (Commercial Recreation) and contains the Hualapai Mountain Lodge, and WHEREAS, there is currently a large seven-bedroom structure on the property that was permitted as a residential home. The applicant proposes to use this building for a bed and breakfast, . and WHEREAS, this item was originally heard at a public hearing before the Planning and Zoning Commission on November 14, 1990. , At that meeting the Commission tabled the item to allow staff to facilitate a public meeting to address many of the concerns of the surrounding property owners. The item was again brought before the Commission on December 9, 1992; however, the item was continued to January 13, 1993. A bed and breakfast would be permitted in an R-M (Multiple Family Residential) zone as stated in the Mohave County Zoning Ordinance. The ordinance indicates in Section 18-B, Uses Permitted: "Commercial Dwellings", with the ordinance defining commercial dwellings as follows: "motel, hotel, rooming house, boarding house, and other similar facilities where a person or group of persons does not assume long-term residency." Staff feels this definition indicates that the requested zoning for R-M would permit the proposed use, and WHEREAS, applicant and staff have notified surrounding property owners on a personal basis to clarify any questions or concerns regarding the proposed zone change. Staff notified by mail all property owners within 300 feet of the subject parcel, allowing property owners to make additional comments due to the inconsistency in the time sequence of this zone change request, and WHEREAS, the only portion of property requested by the proposed zone change is the western portion of Parcel A, as shown on "Exhibit A". The applicant has indicated that they will provide a landscape buffer of 50 feet to create a separation between the proposed use and the residential homes to the west, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 13, 1993, the Commission recommended APPROVAL of the Zone Change subject to the following: 1. That the only portion to be rezoned is that portion defined in Exhibit A. 2. The applicant comply with all applicable provisions of the Mohave County Zoning Regulations, including Section 27P (Site Plan Requirements). 3. That appropriate zoning, building, environmental and floodplain permits be obtained prior to establishment of the bed and breakfast. 4. That a Record of Survey be recorded for the portion of property to be rezoned RM/3A. 5. That a landscape buffer of 50 feet be established on the western boundary of property as shown on Exhibit A. RESOLUTION NO. 93-322 Page 3 PAGE '3 OF 4- BK 2305 PG 660 (FEE~93-6279S) WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation, in Kingman, Mohave County, Arizona, October 17, 1993, and posted October 14, 1993, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 1, 1993, approved this zone change as recommended by the Mohave County Planning and .__ Zoning Commission and outlined herein. ..
