MIQl)fIl.MfD RESOLUTION NO. 93-311 A RESOLUTION SETTING FORTH A ZONING USE PERMIT FOR THE ESTABLISHMENT OF A TELEVISION ANTENNA TOWER IN A C-2 (GENERAL COMMERCIAL) ZONE ON LOT 5, BLOCK P, GOLDEN SHORES UNIT 7, SECTION 11, TOWNSHIP 16 NORTH, RANGE 21 WEST, IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1993, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above described property to applicant Americable Int. Arizona, Inc. of Topock, Arizona, and WHEREAS, the property is located approximately 1,000 feet north of County Route 1 west of the Oatman-Topock Highway. The property is accessed from the Oatman-Topock Highway via Chinle Place, then west approximately 130 feet to Cerro Colorado Drive, then north approximately 200 feet to the southeast corner of the property,. and WHEREAS, review of Floodplain Map #040058-2325B indicates this parcel is located in Zone C, an area of minimal flooding. The surrounding land uses consist primarily of commercial related businesses. There is a storage unit to the north and a few office buildings to the east. The property located directly south and west is currently vacant, and WHEREAS, there is currently a small building, three satelli te dishes and an antenna tower located on the property. The zoning for this property is C-2H (General Commercial/Highway Frontage), and WHEREAS, the antenna tower is approximately 45 to 50 feet in height. The parcel being used for this antenna site is approximately 80 feet in width, and e WHEREAS, the Mohave County Zoning Ordinance, Section 27-B.2, states: "Any water tower or other structure, where a large weight would be supported by supports, logs, or structural walls, shall be so located that, if it should collapse, its reclining length , would still be contained on the property on which it was 6~ constructed," and ~. ..... - '- -', ~ .. &~ "':,:_~~';.;;;' I . ~ ;!)j'f.,~:. rt~ :-;~."'::;.' \._~-,:.~,~ ......./ . ~E 2 OF 2 8K 2305 PG 635 (FEE~93-62788) RESOLUTION NO. 93-311 Page 2 WHEREAS, this parcel is located within the Urban/Building Overlay Zone, and WHEREAS, the Planning and Zoning Department recommended DENIAL of the proposed Zoning Use Permit based on Section 27-B.2 and that if the existing antenna should collapse, its reclining length would not be contained on the property on which it was constructed. The Planning and Zoning Commission did not concur with staff's recommendation, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 13, 1993, the Commission recommended APPROVAL of the Zoning Use Permit subject to the following: 1. The applicant comply with all applicable provisions of the Mohave County zoning Regulations. 2. That appropriate zoning, building, environmental and floodplain permits be obtained. 3. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then . approval shall terminate at that date. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation, in Kingman, Mohave County, Arizona, October 17, 1993, and posted October 14, 1993, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 1, 1993, approved this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
