PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS ~RECORDINGFEE 0.00 He RESOLUTION NO. 93-290 A RESOLUTION SETTING FORTH A REZONE ON PARCEL 42-A AS SHOWN ON RECORD OF SURVEY RECORDED APRIL 30, 1993 IN BOOK 10, PAGE 63 AT FEE NO. 93-23350, BEING A PORTION OF PARCEL 42 OF PEACOCK MOUNTAIN RANCHES, FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONES, LOCATED IN SECTION 7, TOWNSHIP 21 NORTH, RANGE 15 WEST, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 4, 1993, a public hearing was conducted to determine whether approval should be granted for a zone change on the above described property to owners Matthew and Karin Dolph of San Francisco, California, and WHEREAS, the subject property is located approximately two miles east of the City of Kingman and approximately one mile north of Interstate 40. The property is accessed by Interstate 40 via D.W. Ranch Road, thence northwest on Roundup Avenue approximately one and one-half miles to the southerly corner of the property, and WHEREAS, Parcel 42-A was created by Record of Survey recorded on April 30, 1993. The IS-plus acre site is bounded on the southwesterly side by Roundup Avenue, a 70-foot right-of-way. Contiguous and within the easterly boundary is 25 feet of a 50- foot roadway and public utility easement. Currently, no utilities serve this property. Surrounding land uses consist primarily of vacant land with the exception of six distant and widely scattered residences. Site topography is comprised of rolling terrain sloping from the southeast to the northwest, and WHEREAS, review of Floodplain Map #040058-2350C indicates this parcel is within Zone C, an area of minimal flooding, and WHEREAS, the subject property is not within the Urban/Building Overlay Zone or an Area Plan. This is the fourth proposed rezone within the Peacock Mountain Ranch area. " RESOLUTION NO. 93-290 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 8, 1993, the Commission recommended APPROVAL of the zone change and resultant lot split subject to the following conditions: 1. The three parcels be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The three parcels will meet or exceed five acres exclusive of road easements or rights-of-way. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6 . That appropriate zoning/building/environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. That the Board of Supervisors accept the dedications of: the 25-foot roadway easement with a portion of the 50-foot radius cul-de-sac bulb and 25-foot connecting radius curve, and a 20-foot radius curve at the intersection of the aforementioned easement and Roundup Avenue. This shall be approved through the recording of the resolution authorizing the zone change, and the dedication shall be shown via an acceptance statement and be identified on the Parcel Plat. 8 . I f these conditions are not met wi thin one year this approval will. be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to: grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 19, 1993, and posted September 17, 1993, as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on October 4, 1993, approved this zone change, as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~...
