A RESOLUTION SETTING FORTH A PRELIMINARY SUBDIVISION PLAN AND
PETITION OF EXCEPTION FOR ALSTON CERBAT RIDGE, TRACT 3046, BEING
A SUBDIVISION OF PARCEL "A" IN NEW KINGMAN ADDITION UNIT 11, NE~
OF SECTION 30, TOWNSHIP 22 NORTH, RANGE 16 WEST, LOCATED IN THE
KINGMAN AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on October 4, 1993, a public hearing was
conducted to determine the approval of a Preliminary Subdivision
Plan and Petition of Exception for ALSTON CERBAT RIDGE, Tract
3046, and
WHEREAS, the owner/subdivider

WHEREAS, this property is located on the south side of
Jagerson Avenue, south of Mohave Community College. The proposed
subdivision is situated between North Van Nuys Street and North
Bond Street. Access to the Multi-Family and Commercial lots will
be from Jagerson Avenue, as approved by the Mohave County Public
Works Department. Access to the Single Family lots will be from
Carver and McVicar Avenues which will be extended through the
subdivision, and
WHEREAS, the Preliminary Plan depicts 13.35 acres subdivided
into 32 lots, consisting of one commercial lot at 95,044 square
feet; one Multi-Family residential lot at 95,044 square feet; and
30 Single Family residential lots ranging from 9,540 square feet
to 10,654 square feet, and
WHEREAS, the developer intends electric power, telephone,
and gas be provided by Citizens Utilities Company; domestic water
by City of Kingman; sewage treatment by on-site septic systems;
solid waste disposal by private carrier to Mohave County
Landfill. Hualapai Valley Fire Department will provide fire
protection, and

WHEREAS, this matter was continued from the May P&Z meeting
for further evaluation by staff at the request of the Commission.
A concern was expressed by members that lots on the south end of
the proposed subdivision bordering a drainage channel may be
unsuitable for on-site septic systems due to possible problems
complying with setbacks from the wash, and
WHEREAS, a discussion on May 25, 1993 with David Jefferson
of the Mohave County Environmental Health Department verified
that lots 1 through 10, Block 3 (the lots abutting the 70-foot
wide drainage channel) meet the minimum Mohave County
requirements for the installation of on-site septic systems. He
did, however, state that all homes built on lots 1-10, Block 3,
must be built on the rear portion of the lot with the septic
systems in the front yard. This placement is necessary in order
to locate both home and septic system on the lot in compliance
with the 50-foot required setback from the edge of the drainage
channel which abuts the rear of the lots, and

WHEREAS, on June 17, 1993 a letter from ADEQ, signed by
Girish Desai, was received in the P&Z Office stating that the
subdivision could not be approved as submitted. The letter
listed three reasons for denial, and
WHEREAS, on June 18, 1993 the developer and engineer were
notified that this subdivision and related items were being
pulled from the P&Z Agenda until ADEQ approval was obtained.
WHEREAS, on August 23, 1993 a Certificate of Approval of
Sanitary Facilities for the subdivision from ADEQ was hand-
delivered by Chris Alston to Veryl Morrell. The certificate
specified that each lot owner shall connect ot the public sewer
when it becomes available.

1. A Petition of Exception submitted as follows:
I. Eight-foot Public Utility Easements at the front of
lots.
This petition submitted requests for approval of
exceptions from the subdivision regulations as
outlined in Article 1.13 for the following reason:

said property is that the utility companies
have requested easements to be placed in front
of the lots.

2. Per Mohave County Environmental Health Department:
Lots 1 through 10, Block 3, must have the septic
systems installed in the front portion of the lots.
The homes must be built in the rear portion of the lots
due to the required fifty (50) foot setback between the
septic system and the 70-foot PUE and drainage channel
abutting the rear of the lots.

3. Each lot owner shall connect to the public sewer when
it becomes available.

The approval of this subdivision was based on the
understanding of the Commission and the Board of
Supervisors that all streets within the subdivision
will be constructed and paved with asphaltic concrete
in accordance with Standard Specification #171 and
#101.10D of the County Engineering Road Standards or
better; ,all of the interior streets will be standard
crown and contour ditches at the shoulders. The water
quantity and quality will be approved by the Arizona
Department of Water Resources. The water distribution
system, including adequate pressure and volume for fire
flows, will be constructed to serve each lot and be
approved by the Arizona Department of Environmental
Health. Sewage will be by on-site septic systems.
Grading and drainage related improvements will be made
as recommended by the design engineer in the submitted
drainage reports and as approved by the County
Engineer. Electric and telephone service shall be
provided to each lot in accordance with Arizona
Corporation Commission regulations. Signed and
ratified service contracts from all purveyors of
service to this subdivision are required. All lots and
street centerline monuments will be staked and
monumented in accordance with Standard Specification
#102 of the County Public Works Department. Fire
hydrants will be provided at locations prescribed by
the Hualapai Fire Department; street name and regulator
signs will be installed in accordance with the
requirements of the Mohave County Subdivision
Regulations and as recommended by the design engineer.
As a condition of approval, the owner/subdivider is
responsible for the completion of these site
improvements and shall provide an assurance for all
required subdivision improvements in accordance with
Article V of the Subdivision Regulations.

5. A corporate entity for this project shall be
formed/allow for provisions of perpetual maintenance
for the project~s block walls, park areas, or any other
facility deemed private in nature, as detailed in the
CC&Rs. Moreover, the articles of incorporation forming
the property owners association shall be submitted as
per Mohave County Subdivision Regulations.
6. A one-foot vehicular non-access easement shall be
provided for any double-fronted lots.
7. The one-foot vehicular non-access easement as
designated on the plat will have a six-foot minimum
block wall erected upon it to ensure non-access.
8. Zoning resolution shall include the minimum setbacks as
illustrated on the approved Preliminary Plan and dated
received by the Planning and Zoning Department on March
31, 1993.

WHEREAS, that notice of hearing has been met and published
throughout this subdivision process as required by Arizona
Revised Statutes and Mohave County Regulations, and the public
was afforded notice of this action through advertisement of the
Board of Supervisors meeting for this date.

Supervisors, at their regular meeting on Monday, October 4, 1993,

County Planning and Zoning Commission and outlined here in.
