A RESOLUTION SETTING FORTH A REZONE ON THE WEST 408 FEET OF
PARCEL 236, FROM A-R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE
MINIMUM LOT SIZE) ZONE TO A-R/3A (AGRICULTURAL-RESIDENTIAL/THREE
ACRE MINIMUM LOT SIZE) ZONES AND C-l (NEIGHBORHOOD COMMERCIAL)
ZONE, AND THE RELATED EXTINGUISHMENT OF A PORTION OF THE ROADWAY
EASEMENTS WITHIN THE ABOVE PARCEL AS FOLLOWS: 20 FEET FROM BELLE
DRIVE, 8 FEET FROM TEDDY ROOSEVELT ROAD, AND 8 FEET FROM AGUA
FRIA DRIVE IN SECTION 6, TOWNSHIP 21 NORTH, RANGE 18 WEST, IN THE
GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA.

WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on October 4, 1993, a public hearing was
conducted to determine whether approval should be granted for a
zone change on the above described property to owner Larry R.
Townsend of Santa Ana, California, and
WHEREAS, access to the subject property is via Hwy. 68 to
Teddy Roosevelt Road, thence north approximately one mile to the
site~s southwest corner, and
WHEREAS, currently the site is vacant. Surrounding land
uses consist of a few residences to the west, undeveloped land to
the east and south; the land to the north is owned by the BLM.
Site topography is relatively flat with grassy vegetation. On-
site utilities are nonexistent although electric is within one-
quarter mile. A fire hydrant is located on the southwest corner
of Agua Fria Drive and Teddy Roosevelt Road directly west of the
property seeking C-l zoning, and
WHEREAS, review of Floodplain Map #040058-2150B indicates
this parcel is within Zone C, an area of minimal flooding, and
WHEREAS, an amendment to the Golden Valley Area Plan, BOS
Resolution No. 91-23, designated a CN (Commercial Neighborhood)
land use for the northwest corner of Section 6, Township 21
North, Range 18 West. With the exception of commercial uses at
the above corner and four others, the remainder of Section 6 (see
attached Exhibit "A") is designated for single and multi-family
residential uses. The corner is bounded by two section line
roads, Agua Fria Drive on the north and Teddy Roosevelt Road on

WHEREAS, the west half of Teddy Roosevelt Road and the south
half of Agua Fria Drive have been previously dedicated at a width
of 42 feet. All roads within and contiguous to the subject
property exist as 50-foot easements. The applicant is seeking a
matching dedication of the aforementioned section line roads and
a 30-foot dedication on the north half of Belle Drive. The
applicant is also requesting that the remainder of the roadway
easements after dedication be extinguished, and
WHEREAS, the subject property is within the Urban/Building
Overlay Zone and water is via the Valley Pioneer Water Company,
and
WHEREAS, Staff recommends approval of the proposed rezone as
it is in conformance with the Golden Valley Area Plan, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on September 8, 1993, the
Commission recommended APPROVAL of the zone change and resultant
lot split subject to the following:
1.
The two southern parcels be zoned A-R/3A (Agricultural-
Residential/Three Acre Minimum Lot Size) and the
northern parcel be zoned C-l/4A (Neighborhood
Commercial/Four Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The three parcels will meet or exceed their respective
minimum acreages exclusive of road easements or rights-
of-way.
4. Each parcel shall have legal access.
5. The Parcel Plat shall show any surface drainage and
FEMA flood zones.
6. That appropriate zoning/building/environmental and
floodplain permits be obtained prior to any
development. These permits will not be issued until
Parcel Plat recordation.

7. That the Board of Supervisors accept the dedications of
a 42-foot right-of-way on Aqua Fria Drive, a 42-foot
right-of-way on Teddy Roosevelt Road, a 30-foot right-
of-way on Belle Drive, and two 20-foot radius curves
for the northwest and southwest corners of the subject
property respectively. This shall be approved through
the recording of the resolution authorizing the, zone
change, and the dedication shall be shown via an
acceptance statement and be identified on the Parcel
Plat.
8. That the remaining 20 feet of roadway easement on Belle
Drive, 8 feet of roadway easement on Agua Fria Drive
and 8 feet of roadway easement on Teddy Roosevelt Road
be extinguished. This shall be approved through the
recording of the resolution authorizing the zone change
and be identified on the Parcel Plat.
9. The granting of an eight-foot public utility easement
along the north, west and south boundaries of the
subject property to be identified on the Parcel Plat.
10. The rezone shall not become effective for 30 days after
final Board of Supervisors approval for the change in
classification, as per ARS 11-829E.

I f the above conditions are not met wi thin one year
this approval will be void. If at the expiration of
this period the property has not been improved to meet
the use for which it was conditionally approved, the
Board (after notification by registered mail to the
owner and applicant who requested the rezoning) shall
schedule a public hearing to: grant an extension,
determine compliance with the schedule for development
or cause the property to revert to its former zoning
classification. This action is in accordance with
Arizona Revised Statutes Annotated, Title 11, Chapter
6, 11-832.
For the parcel zoned C-1/4A, compliance with all
applicable provisions of the Mohave County Zoning
Regulations including Section 27.P (Site Plan
Requirements) and Ordinance 87-1 (Dark Sky Ordinance).

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman,
Mohave County, Arizona, September 19, 1993, and posted September
17, 1993, as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on October 4, 1993, approved this zone
change, as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
