PAGE 1 OF 3 HOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 He RESOLUTION NO. 93-281 A RESOLUTION SETTING FORTH A REZONE OF LOT 132, BERMUDA PLANTATIONS UNIT 2, FROM R-E (RESIDENTIAL RECREATION) ZONE, TO C- 2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) LOCATED IN SECTION 15, TOWNSHIP 17 NORTH, RANGE 22 WEST, LOCATED ON THE NORTHEAST CORNER OF HARBOR AVENUE AND VACATION DRIVE IN THE SOUTH MORAVE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held October 4, 1993, a public hearing was conducted to determine whether approval should be granted for a zone change for the above described property owned by B. J. McClurg, Jr., of Mohave Valley, Arizona, and .....'O:~ t;.~'~~__..!~ (,"-- " WHEREAS, Bermuda Plantations Unit 2 is located just north of the Colorado River and Needles, California, and southeast of the intersection of Highway 95 and Courtwright Road. The property is located at the intersection of Harbor Avenue and Vacation Drive, and WHEREAS, review of Floodplain Map #040058-2165C indicates the parcel to be located in Zone C. The property is currently vacant and is zoned R-E. The surrounding land uses consist of residential homes to the east and west. There is a sales office located to the south and vacant property to the north. There are a number of commercial businesses located further north along Harbor Avenue. The zoning surrounding this parcel consists of C- 2H (General Commercial Highway Frontage) zoning to the north, C-2 (General Commercial) zoning to the south, with the properties to the east and west being zoned R-E (Residential Recreation), and WHEREAS, land use changes in this area are governed by P&ZC Resolution No. 83-66 (General Development Plan for Section 15, Township 17 North, Range 22 West, in the South Mohave Valley Area) . The plan indicates an expected increase in traffic passing over the Needles Bridge and along Harbor Avenue to Highway 95, and that there will be a pronounced demand for commercial establishments which cater to and are supported by large volumes of traffic. Staff feels this request falls within the guidelines and parameters of this plan, and r..~~:~.', WHEREAS, this lot is located in an Urban/Building Overlay ::ry Zone, and - _./ . ' . . WHEREAS, Harbor Avenue has an existing dedicated roadway width to the north of 42 feet, and a 6-foot VNE and a 25-foot drainage easement along the right-of-way line. Harbor Avenue to the south and adjacent to Lot 132 has an existing dedicated roadway width of 25 feet, and WHEREAS, the Mohave County Public Works Department had requested the dedication of 17 feet of roadway on Harbor Avenue along the western boundary of the subject property, and WHEREAS, the parcel is currently greater than one acre in size. If the additional 17 feet of roadway is dedicated, it will reduce Lot 132 below one acre. If the lot falls below one acre, C-2H zoning regulations would allow a reduced lot size. Staff would propose a 30,000 square foot minimum lot size, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 8, 1993, the Commission recommended APPROVAL of the requested zone change subject to the following conditions: G2~ 1. The parcel be zoned C-2H/30M Highway Frontage/Thirty Thousand Lot Size). That appropriate zoning/building/environmental floodplain permits be obtained. (General Commercial Square Foot Minimum 2 . and 3. That the zone change is conditional to a restriction that the Planning and Zoning Department shall deny the issuance of a permit to construct a building within a 17 foot distance from the existing west property line of Parcel 132 on Harbor Avenue. This restriction is specific in regarding a building and does not include structures, such as a fence. 4. The applicant comply with 'all applicable provisions of the Mohave County zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87- 1 (Dark Sky Ordinance) is also required. 5. The rezone shall not become effective until 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave i-:;~ County, Arizona, September 19, 1993, and posted September 17, 1;~>~9 1993, as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. RESOLUTION NO. 93-281 Page 3 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 4 1993, approved this zone change, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
