A RESOLUTION SETTING FORTH A ZONING USE PERMIT ( ZUP) FOR THE
ESTABLISHMENT OF A TEMPORARY SALES TRAILER LOCATED IN AN SD /R
(SPECIAL DEVELOPMENT/RESIDENTIAL) ZONE, ON PRELIMINARY TRACT NO.
4132F, DESERT LAKES GOLF COURSE AND ESTATES, IN THE NE~ OF THE
NW~ OF THE NE~ OF SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST,
LOCATED AT THE INTERSECTION OF JOY LANE AND CLUB HOUSE DRIVE IN
THE SOUTH MOHAVE VALLEY AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held October 4, 1993, a public hearing was
conducted to determine whether approval should be granted for a
Zoning Use Permit for the above described property to the
applicant, Angelo Rinaldi of Desert Lakes, Lago Enterprises, Inc,
and

WHEREAS, Desert Lakes Golf Course and Estates is located
approximately one-half mile east of Highway 95, south of Joy Lane
and north of Lipan Boulevard. Tract No. 4132F is accessed from
Highway 95 via Joy Lane, east approximately one-half mile to the
northwest corner of the subject property, and
WHEREAS, review of Floodplain Map #040058-2445C indicates
this parcel to be located in Zone A. The property is currently
vacant, with the surrounding land uses consisting of an
elementary school to the west and residential property to the
north, east and south. Many of the surrounding lots are vacant
with residential homes to the east currently used for model
homes. There are scattered homes to the south along the golf
course which are a part of Desert Lakes Golf Course and Estates.
There are also scattered homes located to the north in Fort
Mohave Mesa Ranchos, and
WHEREAS, Tract 4132F is currently under the planning stage
with a preliminary subdivision plan on file with the Mohave
County Planning and Zoning Department. This tract is contiguous
to the currently recorded Desert Lakes Golf Course and Estates,
Tract 4076, and

WHEREAS, the applicant would like to use the sales trailer
to sell parcels in the Desert Lakes subdivision. The applicant
has also indicated that they will provide temporary rest room
facilities and bottled water, and

WHEREAS, this parcel is located within an Urban/Building
Overlay Zone, and
WHEREAS, this item was continued from the August 11, 1993,
Planning and Zoning Commission meeting. The Commission had
reservations about approving the Zoning Use Permit when certain
improvements in connection with Desert Lakes Golf Course and
Estates were not completed, and
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on September 8, 1993, the
Commission recommended APPROVAL of the requested Zoning Use
Permit subject to the following conditions:
1. The applicant comply with all applicable provisions of
the Mohave County Zoning Regulations.
2.
That appropriate zoning/building/environmental
floodplain permits be obtained.
and
3.
That the sales trailer be used for sales of property
and homes in Desert Lakes Golf Course and Estates only.
4.
That there be on-site rest room facilities.
5. If construction or use has not commenced within one
year of Board approval of the Zoning Use Permit or if
the use has been discontinued for six months, then
approval shall terminate at that date.
6. Joy Lane is not to be used as access to the property.
7. This Zoning Use Permit is subject to revocation upon 60
days notification by the Board of Supervisors if, in
the opinion of the Commission and Board, the continued
use of the property would be contrary to the public
health, safety, and welfare.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation in Kingman, Mohave
County, Arizona, September 19, 1993, and posted September 17,
1993, as required by Arizona Revised Statutes, and the Mohave
County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, October 4 1993, approved this
Zoning Use Permit, as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
