A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF FAIRWAY ESTATES, TRACT 4097,
FORMERLY KNOWN AS LAKEVIEW VILLAGE, BEING A PORTION OF SECTION
35, TOWNSHIP 19 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MORAVE
VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on October 4, 1993, a public hearing was
conducted to determine the approval of an Extension of Time for
FAIRWAY ESTATES, Tract 4097, and
WHEREAS, the owners/developers of this tract are Glen L. and
Pearle A. Ludwig, San Bernardino, California. The engineer of
record on this project is Richard J. Rieker, P. E., of Ludwig
Engineering, San Bernardino, California, and
.:'~' WHEREAS, the proposed subdivision is located in the Fort
Mohave area, approximately three miles south of Bullhead City on
Highway 95 and one-half mile east on Highway 95 on Joy Lane at
the southwest corner of the intersection of Joy Lane and Mountain
View Road, and

WHEREAS, the Preliminary Plan depicts approximately 65 acres
subdivided into 278 residential Lots, plus a 15 acre parcel which
may be utilized as either Multifamily or Neighborhood Commercial,
and
WHEREAS, the water will be supplied by Bermuda Water
Company, electric power by Mohave Electric Cooperative, and
telephone service by Citizens Utility Company. Sewage disposal I
will be provided by Sorenson Utility Company, Inc. Fort Mohave
Mesa Fire Department will be providing fire protection for this
project, and private carrier will be providing the solid waste
(garbage) disposal to Mohave Valley Landfill, and
WHEREAS, Article 3.10 states, "Upon application to the
Commission and prior to the expiration of the time limit,
extensions in increments of one year may be granted by the Board
if the subdivider is actively processing the Final Plat. If such
action is not taken then all proceedings relating to the plat
shall be terminated", and

WHEREAS, in a letter dated July 27, 1993, received by
Planning and Zoning on August 9, 1993, Mr. Richard J. Rieker,
P.E., representative of the owner/developer, states: "Fairway
Estates is a planned unit, single family housing development. As
such, the market absorption rate is more sensitive to the market
demands for housing, ability of a buyer to qualify for financing,
general economic conditions, and affordability than a lot sales
program. Since there was very little demand for the upscale
housing provided for in Tract 4097, the remaining three phases
were temporarily placed on hold since there was sufficient
inventory available. It is noteworthy to mention that all
offsite improvements have been completed for the entire project.
The decision to delay was based upon information obtained
during an exit interview at our model home complex. It
rapidly became apparent that the market demanded
affordability and smaller houses and lots. The emphasis,
therefore, shifted from upscale housing to a product to meet
the needs of the retired, lower income, and first time home
buyers.
To satisfy market demands, the developer recorded and
constructed all subdivision improvements in Fairway Estates
Tract 4148 which is a 76 lot subdivision having 4,500 square
foot minimum lots complete with all urban improvements. The
product has proven to be very successful," and
WHEREAS, the Preliminary Subdivision Plan was approved by
the Mohave County Board of Supervisors on February 5, 1990 via
Resolution Number 90-35. On February 3, 1992, a first Extension
of Time was granted by the Mohave County Board of Supervisors via
resolution number 92-32. This will be the second Extension of
Time, and
WHEREAS, at the public hearing before the Mohave County
Planning Commission, on September 8, 1993, the commission
recommended conditional approval of the requested Extension of
Time subject to the following conditions:
1. Compliance with all conditions as stated in BOS
Resolution Number 90-35.
2.
This Extension of Time will be in effect until February
5, 1994.

WHEREAS, that notice of hearing has been met and published
throughout this subdivision process as required by Arizona
Revised Statutes and Mohave County Regulations, and the public
was afforded notice of this action through advertisement of the
Board of Supervisors meeting for this date.
NOW THEREFORE BE IT FURTHER RESOLVED, that the Board of
Supervisors, at their regular meeting on Monday, October 4, 1993,
approved this Extension of Time for the Preliminary Plan of
Fairway Estates, Tract 4097, as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
