A RESOLUTION SETTING FORTH A REZONE ON PARCEL 42-C OF PEACOCK
MOUNTAIN RANCHES FROM A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE
MINIMUM LOT SIZE) ZONE, PROPOSED TO BE A-R/4A (AGRICULTURAL-
RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) ZONES, IN SECTION 7,
TOWNSHIP 21 NORTH, RANGE 15 WEST, LOCATED APPROXIMATELY TWO (2)
MILES EAST OF KINGMAN CITY LIMITS AND APPROXIMATELY ONE (1) MILE
NORTHWEST OF INTERSTATE 40 IN THE MORAVE COUNTY GENERAL AREA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 7, 1993, a public hearing was
conducted to determine whether approval should be granted for a
zone change for the above described property owned by Joseph D.
and Nikki L. Thelen of San Diego, California, and
WHEREAS, the subject property is located approximately two
miles east of the City of Kingman and approximately one mile
north of Interstate 40. The property is accessed by Interstate
40 via D.W. Ranch Road, thence northwest on Roundup Avenue
approximately one and one-half miles to the southwesterly corner
of the property, and
WHEREAS, Parcel 42-C was created by Record of Survey
recorded on April 30, 1993. The 12-plus acre site is bounded on
the southwesterly side by Roundup Avenue, a 70-foot right-of-way.
Contiguous and within the northwest boundary is a 50-foot roadway
and utility easement. No utilities serve this property, and
surrounding land uses consist primarily of vacant land with the
exception of six distant and widely scattered residences. Site
topography is comprised of rolling terrain sloping from the
southeast to the northwest. A minor wash appears to bisect the
site between the northern and southern portions, and
WHEREAS, Floodplain Map #040058-2350C indicates this parcel
is within Zone C, an area of minimal flooding, and
WHEREAS, the subject property is not within an
Urban/Building Overlay Zone or an Area Plan. This is the third
proposed rezone within the Peacock Mountain Ranch area. Previou9
rezones and resultant splits have not gone under a four-acre
minimum lot size, and

WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on August 11, 1993, the Commission
recommended APPROVAL of the zone change and resultant lot split
subject to the following:
1.
The three parcels be zoned A-R/4A
Residential/Four Acre Minimum Lot Size).

2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The three parcels will meet or exceed four (4) acres
exclusive of road easements or rights-of-way.
4. Each parcel shall have legal access.
5. The Parcel Plat shall show any surface drainage and
FEMA flood zones.
6. That appropriate zoning/building/environmental permits
be obtained prior to any development. These permits
will not be issued until Parcel Plat recordation.
7. That the Board of Supervisors accept the dedication of
the curved 25-foot ingress/egress and utility easement,
one 20-foot radius curve at the intersection of the
aforementioned easement and Roundup Avenue, and one
appropriately sized radius curve where Roundup Avenue
and Siesta Road meet. In addition, the granting of an
8-foot public utility easement along the outside of the
25-foot roadway easement, Roundup Avenue and Siesta
Road. This shall be approved through the recording of
the resolution authorizing the zone change, and that
the granting and dedication be shown via an acceptance
statement on the Parcel Plat.

8. The dedication and granting be identified on the Parcel
Plat.
9. The rezone shall not become effective for 30 days after
final Board of Supervisors approval for the change in
classification, as per ARS 11-829E.

10 . I f these conditions are not met within one year this
approval will be void. If at the expiration of this
period the property has not been improved to meet the
use for which it was conditionally approved, the Board
(after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a
public hearing to: grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification. This action is in accordance with
Arizona Revised Statutes Annotated, Title 11, Chapter
6, 11-832.
NOW THEREFORE BE IT RESOLVED, the notice of hearing was
published in the Kingman Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 19, 1993,
and posted August 23, 1993 as required by Arizona Revised
Statutes, and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 7, 1993, approved
this zone change as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
