RESOLUTION NO. 93-265
A RESOLUTION SETTING FORTH A REZONE ON A PORTION OF THE NE\ AND
THE N~ OF THE SE\ OF SECTION 35 FROM A-R/36A (AGRICULTURAL-
RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, TO A-R/20A
(AGRICULTURAL-RESIDENTIAL/TWENTY ACRE MINIMUM LOT SIZE) ZONES, IN
SECTION 35, TOWNSHIP 24 NORTH, RANGE 19 WEST, LOCATED
APPROXIMATELY TWO AND ONE-HALF (2.5) MILES NORTH OF GRASSHOPPER
JUNCTION AND EAST OF HIGHWAY 93 IN THE MOHAVE COUNTY GENERAL
AREA.
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on September 7, 1993, a public hearing was
conducted to determine whether approval should be granted for a
zone change for the above described property owned by Robert
LaFond of Murrieta, California, and
WHEREAS, the subject property is located approximately 20
miles northwest of Kingman. Access has been granted by ADOT with
conditions (see attached ADOT permit) approximately 200 feet
north of milepost 51 on Hwy. 93. From Hwy. 93 access has been
granted through tax parcel 340-25-005 via a 25-foot easement

subject property. The northern portion is relatively flat and
crossed by a minor wash. The southern portion is situated at the
base of the aforementioned mountain and a neighboring mountain.
Two minor washes cross the southern portion. The applicant is
proposing this 90-plus acre parcel be split into two 24-plus acre
and one 40-plus acre parcels. The 40-plus acre parcel would
encompass the mountainous portion of the site and the two
remaining 24-plus acre parcels would be to the north and south,
and
WHEREAS, review of Floodplain Map #040058-1975B indicates
this parcel is within Zone C, an area of minimal flooding, and

WHEREAS, current zoning in this area is A-R/36A per P&ZC
Resolution No. 86-179. There have been no zone changes in this
section since the passing of the aforementioned resolution. The
subject property is not within an Urban/Building Overlay Zone or
part of an Area Plan, and
WHEREAS, at the public hearing before the. Mohave County
Planning and Zoning Commission on August 11, 1993, the Commission
recommended APPROVAL of the zone change and resultant lot split
subject to the following:
1. The northern and southernmost parcels be zoned A-R/20A
(Agricultural-Residential/Twenty Acre Minimum Lot Size)
and the central/middle parcel remain A-R/36A
(Agricultural-Residential/Thirty-six Acre Minimum Lot
Size) .
2. Submittal and recordation of a Parcel Plat prepared in
accordance with Article 3.16 of the Mohave County
Subdivision Regulations.
3. The three parcels will meet or exceed their respective
acreage exclusive of road easements.
4. Each parcel shall have legal access.
5. The Parcel Plat shall show any surface drainage and
FEMA flood zones.
6. That appropriate zoning/building/environmental permits
be obtained prior to any development. These permits
will not be issued until Parcel Plat recordation.
7. The granting of a 50-foot ingress/egress and public
utility easement along the west boundary of the subject
property beginning at the point of intersection with
the 25-foot access road from Hwy. 93 and ending at the
northwest corner of the subject property. This shall
be approved through the recording of the resolution
authorizing the zone change, and that the granting be
shown via an acceptance statement and identified on the
Parcel Plat.
8. The rezone shall not become effective for 30 days after
final Board of Supervisors approval for the change in
classification, as per ARS 11-829E.

9. I f these conditions are not met wi thin one year this.
approval will be void. I f at the expiration of this
period the property has not been improved to meet the
use for which it was conditionally approved, the Board
(after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a
public hearing to: grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification. This action is in accordance with
Arizona Revised Statues Annotated, Title 11, Chapter 6,
11-832.
NOW THEREFORE BE IT RESOLVED, the notice of hearing was
published in the Kingman Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, August 19, 1993,
and posted August 23, 1993 as required by Arizona Revised
Statutes, and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, September 7, 1993, approved
this zone change as recommended by the Mohave County Planning and
zoning Commission and outlined herein.
