'. , r1,,~ () '~ 6u ' <, RESOLUTION NO. 93-258 ,eSo ';" ...>' A RESOLUTION SETTING FORTH A REZONE ON LOT 12, BLOCK D, OF GOLDEN SAGE RANCHOS, UNIT 64 FROM A-R/2A (AGRICULTURAL-RESIDENTIAL/TWO ACRE MINIMUM LOT SIZE) ZONE, TO A-R/1A (AGRICULTURAL- RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONES, IN SECTION 1, TOWNSHIP 22 NORTH, RANGE 19 WEST, LOCATED APPROXIMATELY THREE (3) MILES WEST OF HIGHWAY 93 AND ONE-HALF (.5) MILE SOUTH OF HERMIT DRIVE IN THE GOLDEN VALLEY AREA OF MORAVE COUNTY. WHEREAS, at the regular meeting of the Mohave County Board of supervisors held on September 7, 1993, a public hearing was conducted to determine whether approval should be granted for a zone change for the above described property owned by Carl Vincent of Kingman, Arizona, and WHEREAS, access to the subject property from Kingman is via Hwy. 93 approximately 13 miles to milepost 58, thence west on Hermit Drive approximately three miles, thence south on Glen Canyon Road approximately one-quarter mile to the site's northwest corner, and WHEREAS, the general area is rural in character. Visible from the site are six residences; the rema1n1ng land is undeveloped. Site topography is relatively flat with desert vegetation, and WHEREAS, review of Floodplain Map #040058-2350C indicates this parcel is within zone "C", an area of minimal flooding, and WHEREAS, existing zoning for Golden Sage Ranchos Unit 64 is A-R/2A (Agricultural-Residential/Two Acre Minimum Lot Size) per P&ZC Resolution No. 87-25. Currently Unit 64 contains one nonconforming split (Lot 3, Block P) which occurred in 1983, and one illegal split (Lot 13, Block B) from 1989. with the exception of these two lots the remaining 286 lots have not been split, and WHEREAS, the sub~ect property is not part of an Area Plan, not within an urban/Building Overlay Zone and not within an Improvement District, and WHEREAS, the Planning and Zoning Department recommended DENIAL of the proposed zone change and resultant lot split subject to the following: ,", . . RESOLUTION NO. 93-258 Page 2 PAGE 2 OF 3 BK 2280 PG 39~ (FEE~93-~2096) A. The proposed zone change violates the integrity and interrupts the continuity of the two-acre subdivision. B. The area is undeveloped, thereby making it difficult to justify the need for another lot let alone a smaller lot. WHEREAS, the Planning and Zoning Commission rejected Staff's recommendation because of other splits in the area that had set precedent, and WHEREAS, at the public hearing before the Mohave County Planning and zoning Commission on August 11, 1993, the Commission recommended APPROVAL of the zone change and resultant lot split subject to the following: 1. The two parcels be zoned A-R/1A Residential/One Acre Minimum Lot Size). (Agricultural- 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The two parcels will meet or exceed one acre exclusive of road easements or rights-of-way. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6. That appropriate zoning/building/environmental permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The rezone shall not become effective for 30 days after final Board of superviso~s approval for the change in classification, as per ARS 11-829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to: grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. . .. ,~- . . RESOLUTION NO. 93-258 Page 3 PAGE 3 OF 3 BK 2280 PG 396 (FEE~'3-52096) NOW THEREFORE BE IT RESOLVED, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 19, 1993, and posted August 23, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 7, 1993, approved this zone change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
