PAGE 1 OF 3 MOHAVE COUNTY BOARD Of SUPERVISORS RECORDIHij FEE 0.00 Ht RESOLUTION NO. 93-257 A RESOLUTION SETTING FORTH A REZONE ON THE NW~ OF THE SW~ OF SECTION 27 FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, TO A-R/15A, A-R/10A AND A-R/5A (AGRICULTURAL-RESIDENTIAL/FIFTEEN ACRE, TEN ACRE AND FIVE ACRE MINIMUM LOT SIZE) ZONES, IN SECTION 27, TOWNSHIP 23 NORTH, RANGE 18 WEST, LOCATED APPROXIMATELY FOUR (4) MILES SOUTH OF CHLORIDE, EAST OF HIGHWAY 93 AND WEST OF COUNTY ROUTE 125 IN THE GOLDEN VALLEY AREA OF MOHAVE COUNTY. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1993, a public hearing was conducted to determine whether approval should be granted for a zone change for the above described property owned by Katherine Maguire of Chicago, Illinois, and WHEREAS, the subject property is located approximately 4 miles south of Chloride and approximately 15 miles northeast of Kingman. Access is from Hwy. 93 to Mineral Park Road, thence northeast approximately one and one-half miles, thence northwest approximately one mile on County Route 125 to the site's eastern boundary, and WHEREAS, County Route 125 extends through the northeast corner of this 40-acre parcel. The site is relatively flat and covered with desert vegetation. A wash runs through the northerly portion of the property. The site is bounded on the east side by a 30-foot Citizen's Utilities easement; however, within the general area there are no existing utilities. Surrounding uses consist of vacant land with the exception of two distant residences to the northeast, and WHEREAS, review of Floodplain Map #040058-2150B indicates this parcel is within Zone A, an area of the 100-year floodplain, and Zone C, an area of minimal flooding. The aforementioned wash carries the Zone A designation which covers approximately 30 percent of the north half of the subject property, and WHEREAS, per P&ZC Resolution 86-179, zoning in Section 27 is A-R/36A except for the A-R zoning of the SE~ of the SW~ known as New Deal Acres. There have been no zone changes in this section since the passing of the aforementioned resolution, yet there are some 5, 10 and 20-acre parcels. The subject property is not within an Urban/Building Overlay Zone or part of an Area Plan, and . . RESOLUTION NO. 93-257 Page 2 PAGE 2 OF 3 BK 2280 PG 392 <FEEt93-5209Si WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 11, 1993, the Commission recommended APPROVAL of the zone change and resultant lot split subject to the following: 1. The northernmost parcel be zoned A-R/15A (Agricultural- Residential/Fifteen Acre Minimum Lot Size) , the southwest ~arcel be zoned A-R/10A (Agricultural- Residential/Ten Acre Minimum Lot Size) , and the southeast parcel be zoned A-R/5A (Agricultural- Residential/Five Acre Minimum Lot Size). 2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations. 3. The three parcels will meet or exceed their respective acreage exclusive of road easements. 4. Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6. That appropriate zoning/building/environmental permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. That the proposed 50-foot easement be granted at a 90- degree angle from County Route 125 and continue at that angle for a minimum of 200 feet. 8. The granting of an additional 34 feet to be 17 feet on each side of the existing 66-foot easement known as "Old Boulder Dam Highway" now called Chloride Road County Route 125 traversing the property. The granting of the proposed 50-foot roadway and public utility easement with two appropriate radii curves at the intersection of the easement and County Route 125. This shall be approved through the recording of the resolution authorizing the zone change. 9. The grantings be acknowledged via an acceptance statement and identified on the Parcel Plat. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. . . RESOLUTION NO. 93-257 Page 3 PAGE 3 OF 3 BK 2280 PG 393 (FEE~93-520~5) 11. I f these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to: grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. NOW THEREFORE BE IT RESOLVED, the notice of hearing was published in the Kingman Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 19, 1993, and posted August 23, 1993 as required by Arizona Revised Statutes, and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 7, 1993, approved this zone change as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
