SUMMARIZE THE ISSUE&DESIRED ACTION CLEARLY/ATTACH BACKUP MATERIAL:
The warehouse located at 770 W. Beale St. is currently storing approximately 450 inmate food trays that have
been excessively used, badly damaged and contaminated with mold. Due to the contamination we cannot sell
this surplus on auction or donate it to a non-profit organization. Staff recommends the surplus property be
disposed of via recycling, or taken to an approved landfill so that the County does not risk exposure or injury to
the public. All County identifying tags will be removed prior to disposal.
RECOMMENDED MOTION:
Approve the disposal of the unauctionable damaged and/or contaminated surplus property located at 770 W.
Beale St. in the most cost effective way via recycling or taken to an approved landfill, in accordance with
Mohave County Procurement Code, Article VIII Materials Management, Section 2 and A.R.S, §11-251, and
authorize County staff to sign all necessary and convenient documents on behalf of the County as a part of the
disposal, on behalf of the Procurement Department—Central Services Division.

ARTICLE VIII. MATERIALS MANAGEMENT
Sec. 2.Materials Management Guidelines.
In addition to directives issued by the County Administrator, the Procurement Director shall establish additional guidelines
as may be required governing:
Art. VIII, Sec. 2(1) The transfer of surplus property and operation of the surplus property program.
Art. VIII, Sec. 2(2) The sale or disposal of surplus, unclaimed, and seized property by public auction, competitive formal
and informal bid, electronic, or other appropriate method designated by regulation.
Art. VIII, Sec. 2(3) The trade-in of surplus property for purchase of new equipment.
Art. VIII, Sec. 2(4) The purchase of high volume commodities by electronic reverse auction.
Sec. 4.Disposition of Surplus Property.
Art. VIII, Sec.4(1) The Procurement Director will operate a surplus property program for the purpose of receiving,storing,
transferring, or selling surplus property no longer needed by using departments.
Art. VIII, Sec.4(2) Using departments shall use the Property Transfer Form to request authorization to transfer fixed assets
to another department, or to request transfer of property into or from the Surplus Property Program.
Art. VIII, Sec. 4(3) Unless otherwise provided for, surplus property no longer needed by any using agency shall be offered
for sale through competitive bids, public auction, online sales, established markets in accordance with A.R.S. §11-251.
Sales by competitive bid will be conducted in accordance with Article III, Sec. 3(Competitive sealed bidding)or Article III,
Sec.6(Small purchases), except that sale shall be made to the highest responsible bidder.Public auctions may be conducted
on site or electronically.
Art. VIII, Sec. 4(4) Unless otherwise provided, all proceeds from sale or auction of surplus property will be deposited into
the County's general fund. Proceeds from sale of enterprise,federal, grant or other special designation property will be
reimbursed, less prorated selling expenses, to the appropriate fund, after completion of each sale.
I1-251. Powers of board
The board of supervisors, under such limitations and restrictions as are prescribed by law, may:
9. Sell at public auction, after thirty days'previous notice given by publication in a newspaper of the county, stating the
time and place of the auction, and convey to the highest bidder,for cash or contract of purchase extending not more than
ten years from the date of sale and on such terms and for such consideration as the board shall prescribe, any property
belonging to the county that the board deems advantageous for the county to sell, or that the board deems unnecessaryfor
use by the county, and shall pay the proceeds thereof into the county treasury for use of the county, except that personal
property need not be sold but may be used as a trade-in on the purchase of personal property when the board deems this
disposition of the personal property to be in the best interests of the county. When the property for sale is real property, the
board shall have such property appraised by a qualified independent fee appraiser who has an office located in this state.
The appraiser shall establish a minimum price, which shall not be less than ninety per cent of the appraised value. The
notice regarding the sale of real property shall be published in the county where the property is situated and may be
published in one or more other counties, and shall contain, among other things, the appraised value, the minimum
acceptable sale price, and the common and legal description of the real property. Notwithstanding the requirement for a
sale at public auction prescribed in this paragraph, a county, with unanimous consent of the board and without a public
auction, may sell or lease any county property to any other duly constituted governmental entity, including the state, cities,
towns and other counties.A county,with unanimous consent of the board and without public auction,may grant an easement
on county property for public purposes to a utility as defined in section 40-491.A county, with unanimous consent of the
board and without public auction, may sell or lease any county property for a specific use to any solely charitable, social
or benevolent nonprofit organization incorporated or operating in this state. A county may dispose of surplus equipment
and materials that have little or no value or that are unauctionable in any manner authorized by the board.
