MOHAVE COUNTY ORDINANCE NO. 2020-01
A RESOLUTION SETTING FORTH AN AMENDMENT TO THE MOHAVE COUNTY
ZONING ORDINANCE,SECTION 37.A SPECIAL USES,TO ALLOW UPDATES TO BE MADE
TO THE SPECIAL USES ORDINANCE.
WHEREAS,at the regular meeting of the Mohave County Board of Supervisors held on Monday,
February 3, 2020, a public hearing was conducted to determine whether approval should be granted for
an Amendment to the Mohave County Zoning Ordinance, as requested by Mohave County, and
WHEREAS, as requested by the Board of Supervisors, staff has reviewed and amended Section
37.A Special Uses in regards to temporary events.Changes are being proposed to help eliminate vagueness
and to allow for an administrative process for smaller events. As recommended by the County Attorney,
staff has removed"temporary"from this section and replaced it with"re-occurring(less than 6 months)".
Staff has also defined large assemblages of people to 50 or more persons expected in attendance. A new
ordinance addressing Special Events that are not re-occurring or permanent is being proposed in a separate
item, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect comply with the Mohave County General Plan.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission
on January 8, 2020, the Commission recommended APPROVAL of this Amendment to the Mohave
County Zoning Ordinance, and
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman,Mohave County,Arizona on January 19,2020,and was posted on January
17,2020, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT ORDAINED,that the Board of Supervisors,at their regular meeting
on Monday, February 3, 2020, ADOPTED this Ordinance to amend the Mohave County Zoning
Ordinance as follows (items to be deleted are struck; items to be added are bolded and double
underlined):
Section 37 GENERAL PROVISIONS
A. Special Uses The following uses may be permitted in zones in which they are not specifically
permitted by this Ordinance, where such uses are deemed essential or desirable to the public
convenience or welfare,and are in harmony with the various elements or objectives of the General
Plan.
In each instance,the matter shall be processed as a Special Use Permit.
1. Airports or aircraft landing fields, permanent public utility facilities (does not include
distribution lines), and communications installations, and public and private sanitary
landfills.
2. Cemeteries, columbariums, crematories and mausoleums.
3. Establishments of temper re-occurring(less than 6 months) or permanent enterprises
involving large assemblages of people or automobiles (50 or more expected in
attendance), including amusement parks, circuses, fairgrounds, open- air theaters, race
tracks, and recreational centers. (For Special Events that are not re-occurring or
permanent see Section 37.Z.)
4. Layout and construction of model homes and their use as sales office in an approved
subdivision prior to Final Plat recordation.
5. General Commercial uses that are permitted without a Special Use Permit for the older
mining communities of Oatman and Chloride when the General Commercial uses will
support tourist activities and are within established commercial areas.
6. Renewable energy projects on properties zoned A (General), A-R (Agricultural-
Residential), A-D (Airport Development), R-E (Residential Recreation) or M-2 (General
Manufacturing). An applicant shall demonstrate that neighboring uses will be adequately
buffered.
