HomeMy WebLinkAbout2020-001MOHAVE COUNTY ORDINANCE NO, 2020-01 AN ORDINANCE, FOLLOWING THE RF_,CISSION OF MOHAVE, COUNTY ORDINANCE 2016-05, REINSTATING Ti-IE COUNTY ORDINANCES AS THEY EXISTED BEFORE JUNE 20, 2016; AND PROVIDING FOR THE CONFIRMATION OF ORDINANCES PASSED AFTER JUKE 20, 2016. WHEREAS, the Mohave County Board of Supervisors (the "Board") met in Regular Session this 2 1 " day of January, 2020; and WHEREAS, A.R.S. § 11-251.05 allows the Board, in the conduct of county business, to adopt ordinances necessary or proper to carry out the duties, responsibilities, and functions of the County which are not otherwise in conflict with any rule or law of the State of Arizona; and WHEREAS, A.R.S. § 11-251(31) authorizes the Board to make and enforce all local, police, sanitary and other regulations not in conflict with general law; and WHEREAS, prior to adoption of the ordinance, the Board held a public hearing on the ordinance with at least fifteen days' notice of which was given by publication in a newspaper of general circulation in the county seat; and WHEREAS, on June 20, 2016, the Board adopted Mohave County Ordinance 2016-05 which adopted and enacted a new Code for Mohave County called the "Code of Ordinances, Mohave County, Arizona" published by Municipal Code Corporation. This Code of Ordinances compiled the already existing Mohave County Ordinances into one restated Code; and WHEREAS, since the adoption of the Code of Ordinances, the County has found conflicts within the Code that has created concern, and has created conflict in certain court cases; and WHEREAS, after a thorough review staff has determined that reinstating the original source ordinances as passed by the Board may correct a majority of the conflicts; and WHEREAS, the Board wishes to give effect to the ordinances it passes; WHEREAS, the Mohave County Information Technology Web Programmer developed an in-house ordinance search system that is easily searchable, which system was presented to the Board for review at its meeting on November 4, 2019; and WHEREAS, on January 21, 2020 the Board repealed Mohave County Ordinance 2016-05 and removed the "Code of Ordinances, Mohave County, Arizona" published by Municipal Code Corporation; Ordinance No. 2020-01 Page 1 of 2 WHEREAS, the Board wishes to use the original source ordinances as the governing county ordinances for Mohave County. Original source ordinances are those ordinances passed by the Board at public meetings. NOW THEREFORE, BE IT RESOLVED, the Mohave County Board of Supervisors adopts the following ordinance: 1. The Mohave County Board of Supervisors hereby reaffirms the formal rescission of Ordinance 2016-05. The Board hereby reinstates all Mohave County Ordinances that were in effect prior to the effective date of Ordinance 2016-05. All Mohave County Ordinances and amendments thereto passed after the effective date of Ordinance 2016- 05 shall continue in full force and effect. 2. All ordinances, resolutions and regulations of Mohave County in force at the time this Ordinance is adopted, and not inconsistent with the provisions thereof, are continued in force until the same shall be duly amended or repealed. 3. All ordinances in full force and effect after this date shall be maintained in a manner accessible to the public and in a searchable format.
