HomeMy WebLinkAbout88-078 ( OJ. 0 "_= ~/ I I J (1~ ABANDONMENT OF CERTAIN LOTS IN NORTHSTAR HILLS (.I~ENDED) SUBDIVISION RESOLUTION NO. 88-78 The Board of Supervisors of Mohave County, Arizona, met this 3rd day of October, 1988 in a regular session pursuant to the call of the Chairman in whi,eh all members joined; and WHEREAS, the Board of Supervisors, at their meeting on November 2, 1987, acknowledged receipt of a letter of request from Roy S. Everson, together with a petition signed by ten (lO) resident taxpayers of Mohave County requesting the abandonment of certain lots and recorded dedicated roadway easements for Northstar Hills subdivision (Amended) as recorded on January 5, 1960, at Reception No. 92397 in the Mohave County Recorder's office; and WHEREAS, a petition has been submitted requesting the abandonm€!nt and rever s ion to acreage of certain recorded lots in Northstar Hills (Amended), more specifically described as being: Block 2: Block 3: Block 4: Lots 22, 23, 48 & 49; Lots 1, 5-9, 14-22 & 25-l04; Lots 18-21, 36-43, 70, 71 & 98-100; WHEREAS, this recorded tract is of Wikieup and three (3) miles east Ranch Road; and located five (5) miles north of Highway 93 off the Bogle WHEREAS, this abandonment request has been initiated by Roy S. Everson on behalf of Roy S. Everson, Marline H. Everson (his wife) and Elaine E. Damron (an unmarried woman), as joint tenants and is being requested in conjunction with the abandonment of certain roadway easements within this tract in order to permit the reversion of a portion of this recorded tract to acreage for ranch or agricultural use; and WHEREAS, all of the lots within this tract have been sold to individuals or groups other than the original developers; and WHEREAS, the recorded deed evidences that Roy Everson, et al are the owners of those lots proposed to be abandoned; and WHEREAS, in reviewing Mr. Everson's proposal to abandon lots under his ownership Mciliave County Engineering and Planning staff's recommended that certain easements be retained and additional easements be granted by the owner to insure that no roadways were being vacated that would leave other lots without legal access; and 800(1,19.3 fAGE97B I I I Resolution No. 88-78 Page :2 WHEREAS, this proposal wal:; referred to Mr. Everson and he concurred wi th it. Concurrence was also received from the three (3) ()ther property o~mers wishing to have their groups of lots abandoned; and lIVHEREAS, this abandonment request has been evaluated by the Planning and Zoning Commission J.n accordance with Article l.12 of the Mohave County Subdivision Regulations and their findings submitted to the Board of Supervisors in Resolution P&ZC: 88-155; and WHEREAS, the Planning and Zoning Commission, by Resolution P&ZC: 88-1';5 recommended conditional approval abandonment subject to the terms and condi tions outlined Resolution; and adopting of this in said WHEREAS, the lots to be abandoned are as follows: 1. On behalf of Mr. Roy Everson: Block 2: Lots 22, 23, 48 & 49; Block 3: Lots 1, 5-9, 14-22 & 25-104; Block 4: Lots 18-2l, 36-43, 70, 71, 98-l00; 2. On behalf of Mrs. Marie Kelso: Block 4: Lots 44-49 & abandonment of the these lots; 64-69, recorded but not to include the easements on or across 3. On behalf of Mrs. Fred Feutz: Block 4: Lots 80-88, but not to include abandonment of the recorded easements on or across these lots; 4. On behalf of Ms. Cherie Ross: Block 4: Lots 30-33, but not to include the abandonment of the recorded easements on or across these lots; WHEREAS, the notice for public hearing was published in the Mohave Daily Miner, a newspaper of general circulation in the County Seat on September 18 and 25, 1988, and was posted on September 16, 1988, as required by Arizona Revised Statutes and the Mohave County Zoning Ordinance; and WHEREAS, the Board of Supervisors has the authority to abandon said lots pursuant to A.R.S. 28-1907, A.R.S. ll-806.01 and Article l.12 of the Mohave County Subdivision Regulations; and BCO~ 1493 r ~\~E 979 Resolution No. 88-78 Page 3 I NOW THEREFORE, be it resolved that the Board of Supervisors wi th the concurrence of the owners of record hereby abandon the following lots as recommended by the Planning and Zoning Commission as outlined in Resolution P&ZC: 88-155 and as outlined herein; and Block 2: Block 3: Block 4: Lots 22, 23, 48 & 49; Lots 1, 5-9, 14-22 & 25-104; Lots IB-21, 36-43, 70, 71, 98-l00; Block 4: Lots 44-49 & 64.-69, but not to includE~ the abandonment of the recorded easements on or across these lots; Block 4: Lots 80-88, but not to include abandonment of the recorded easements on or across these lots; Block 4: Lots 30-33, but not to include abandonment of the recorded easements on oOr across these lots; I NOW THEREFORE, be it further resolved that the Board of Supervisors hereby adopts this Resolution No. 88-78 and instructs the Clerk to record this abandonment Resolution simultaneously with the recordation of Board of Supervisors Resolution No. 88-79 abandoning certain roadway easements within Northstar Hills upon recording of a Parcel Plat or similar instrument granting alternative roadway easements as necessary to insure access to the remaining lots and adjoining parcels within this Section.
