ABANDONMENT OF CER'.rAIN RECORDED DEDICATED ROADWAY EASEMENTS
IN NORTHSTAR HILLS (AMENDED) SUBDIVISION
RESOLUTION NO. 88-79
The Board of Supervisors of Mohave County, Arizona met this
3rd day of October, 1988, in a regular session pursuant to the call
of Chairman in which all members joined; and
WHEREAS, the Board of Supervisors at their meeting on November
2, 19:97, acknowledged rece ipt of a letter of request from Roy S.
Everson together with a petition signed by ten (10) resident
taxpayers of Mohave County requesting the abandonment of certain
lots and recorded dedicated roadway easements for Northstar Hills
Subdivision (Amended) as recorded on January 5, 1960, at
Reception No. 92397 in thE! Mohave County Recorder's office; and
WHEREAS, a petition has been submitted requesting the
abandonment of certain dedicated recorded roadway easements in
Northstar Hills Subdivision (Amended) as follows:
Block 2:
Fifty (50') foot roadway easement common to Lots
23 and 48;~
Block 3:
Fifty (SO') foot roadway easement common to Lots
14-22 and 31-39; Lots 40-52 and 53-65; Lots 66-78
and 79-91
Thirty-three (33') foot roadway easement along the
west boundary of Lots 14, 39, 40, 65, 66, 91 and 92
Thirty-three (33') foot roadway easement along the
south boundary of Lots 93-104
Twenty-five (25') foot roadway easement along the
east boundary of Lots 27, 52, 53, 78, 79 and 104
Block 4: Fifty (50') foot roadway easement common to Lots
43 and 70, and 71 and 98
Thirty-three (33':1 foot roadway easement along the
south boundary of Lots 99 and 100
Twenty-five (25') foot roadway easement along the
west boundary of Lots 42, 43, 70, 71, 98 and 99
'WHEREAS, this recorded tract is located five (5) miles north
of Wikieup and three (3) miles east of Highway 93 on the Bogle
Ranch Road: and
1i'lHE.REAS, this abandonment request has been initiated by Roy S.
Everson on behalf of F~y S.Everson, Marline H. Everson (his wife)
and Elaine E. Damron (an unmarried woman) as joint tenants, and is
being requested in conjunction with the abandonment of certain lots
within this tract in order to permit the reversion of a portion of
this recorded tract to acreage for ranch or agricultural use; and

WHEREAS, all of the lots within this tract have been sold to
individuals or groups other than the original developers; and
WHEREAS, the
deed evidences that Roy Everson et al
roadways easements proposed to be
recordl~d
are the owners
of those
abandoned; and
WHEREAS, the dedication on the recorded map of Northstar Hills
recorded January 5, 1960, at Reception No. 92397 indicates that all
easements dedicated for I:he purposes shown on the plat. The plat
shows roadway easements around the perimeter of the section and
interior roadway easements across each lot. The typical easement
depicted on the recorded plat indicates a thirty-three (33') foot
roadway easement and a fifty (50') foot roadway easement or twenty-
five (25') feet on either side of the lot line; and
WHEREAS, the County Engineering Department recommended that
certain roadway easements proposed to be abandoned not be abandoned
to insure that no roadways were being vacated that INould leave
other lots without legal access; and
the apI)licant concurred with this recommendation; and
the revised roadway easement abandonment request is

40-52/66-78/79-91 and over the east boundary of
Lots 27, 52, 53, 78, 79 and 104
Block 4: Those roadway easl,~ments on Lots 43 and 70, 71 and
98 and the west boundary of Lots 42, 43, 70, 71
98 and 99
WHEREAS, this abandonment request has been evaluated by the
Planning and Zoning Commission in accordance with Article l.12 of
the Mohave County Subdivision Regulations and their findings
submitted to the Board of Supervisors in Resolution P&ZC: 88-155;
and
vmEREAS, the Planning and Zoning Commission by adopting
Resolution P&ZC: 88-155 recommended conditional approval of this
abandonment subject to the terms and conditions outlined in said
Resolution; and
'WHEREAS, the not ice for Pub 1 i c Hear ing was publ i shed in the
Mohave Daily Miner, a newspaper of general circulation in Mohave
County, on September 18, 1988, and September 25, 1988, as required
by Arizona Revised Statues and the Mohave County Zoning Ordinance,
and was posted on September 6, 1938; and

WHEREAS, the Board of Supervisors has the authority to abandon
said streets, parcel sand publ:l c ut i 1 i ty and drainage easements
pursuant to A.R.S. 28-l907, A.R.S. ll-806.01 and Article 1.12 of
the Mohave County Subdivision Regulations; and
NOW THEREFORE, bl~ it resolved that the Board of Supervisors
hereby abandons the following roadway easements wi thin Northstar
Hills as recommended by the Planning and Zoning Commission as
outlined in Resolution P&ZC: 88-155 and as outlined herein,
Block 3: Those roadway easements on Lots 14-22/31-39, 40-52/
53-65, 66-78/79-91 and over the east boundary of
Lots 27, 52, 53, 78, 79 and 104
Block 4: Those roadway easements on Lots 43 and 70, 7l and 98
and the west boundary of Lots 42, 43, 70, 7l, 98 and
99
NOW THEREFORE, be it fur1:her resolved that the Board of
Supervisors hereby adopts this Resolution No. 88-79 and instructs
the Clerk to record this abandonment Resolution simultaneously with
the recordation of Board of Supervisors Resolution No. 88-78
abandoning certain lots wi thin
Parcel Plat to include the
Northstar Hills upon recording a
alternative roadway easements as
the remaining lots and adjoining
necessary to insure access to
parcels within this section.
