RESOLUTION NO. 97-85 SUPPORT TO ASSUME A LOCAL PHASED-IN FUNDING PLAN TO ESTABLISH MOHA VE COUNTY SUPERIOR COURT DIVISION SIX WHEm:AS, in accordance ",ith the provisions of Title 12 Section 121, ARS which provides that in each county having a census enumeration greater than thirty thousand inhabitants, and upon a petition by the board of supervisors of such county to the governor and his approval the:reof, there shall be an additional judge of the superior court for each thirty thousand inhabitants, or a majority fraction thereof; and WHEID:AS, in accordance with the above Title and Section, the Mohave County Superior Court is eligible for a sixth permanent judgeship when Mohave County has a census enumeration greater than one-hundred and twenty thousand inhabitants; and WHERJ~AS, in accordance with the provisions of Title 12 Section 141, ARS, which provides that upon request of the presiding judge of the superior court, the chief justice of the Arizona Supreme court may appoint judges pro tempore of the superior court for such county in the manner provided by this article and subject to the approval of the board of supervisors of the county, and WHEREAS, in accordance with provisions of Title 41 Section 2401 (H), ARS, which provides that the Arizona Supreme Court shall expend monies received from the criminal justice enhancement fund to enhance the ability of the courts 1to process criminal and delinquency cases and that the salary of superior courts to process criminal and delinquency cases and that the salary of superior court judges pro tempore may be paid in full by the monies received pursuant to this section, THEREFORE, BE IT RESOLVED that the Mohave County Board of Supervisors support th,e establishment of Division Six of the Mohave County Superior Court through use of criminal justice enhancement fund monies for the appointment of a superior court judge pro tempore and supporting staff and that the Board will assume a local phased-in funding plan to support and maintain this Division in the future pursuant to the aforementioned statutory sections.
