RESOLUTION NO. 97-213 A RESOLUTION CONCERNING THE BUREAU OF LAND MANAGEMENT'S AND REGULATIONS CONCERNING MINING WHER..EAS, the Bureau of Land Management recently implemented a rule that requires bonding for miners or explorationists and mine operators. This rule is final; and WHEREAS, neither the Bureau of Land Management nor the Department of Interior gave adequate public notice. Nor did the agency 01' the department provide adequate opportunities for public input; and WHEREAS, the bonding n:quirement places an additional burden on small miners and may prevent some miners from conductiing future work; and WHEREAS, the bonding requir,ement is part of a larger plan to revamp the 43 CFR 3809 mining regulations; and WHEREAS, the Mohave County Public Land Use Committee at their meeting on May 20, 1997 recommended to the Board of Supervisors that the Board adopt a resolution expressing the County's objection to the bonding requirements and specifying the local issues that need to . be addressed in the Environmental Impalet Statement. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at a. special meeting on Monday, June 16, 1997, considered these items and concluded as follows: 1. The Board of Supervisors objects to the new rule requiring bonding and believes that the rule should be suspended until adequate public notice has been given and the public has been given adequate chance to comment. This process could be part of the revamping of 43 CFR 3809. 2. The Environmental Impa'~:t Statement currently being conducted must address the economic impacts to the local economy. Analysis at national or regional level will mask local impact inc:1uding the impact to Mohave County. 3. The Bureau of Land Management must evaluate their ability to administer any program. The new regulaltions cannot be allowed to slow down the existing permitting process. . . RESOLUTION NO. 97-213 . . 4.
