WHI<~REAS, the Board of Supervisors of Mohave County met in Special
:-icsslon this 10th day of March" 1995, and
WHEREAS, Mohave County is the fifth largest county in the United States
and includes vast areas of federal land administered by the BLM and other
agencies; and
WHEREAS, The Federal Land Policy and Management Act of October 21,
1~n6, (FLPMA) repealed Revised Statute (R.S.) 2477 which provided, the right-of-
way for the construction of highways over public lands, not reserved for public use
is hereby granted; and
WHEREAS, R.S. 2477 was enacted by Congress July 26, 1866, and many of
the roads, paths, and ways on public land, in Mohave County, were constructed
under this grant of authority. They serve as trails, as mining roads, they are
recreation access roads, they are ingress and egress roads to state and private
Inlll(Js (even state and private lands captured within federal reservation areas). In
fact. many are roads, paths and ways which remain under the jurisdiction of the
highway authorities of the state, county, cities or towns where they are located;
and
WHEREAS, it is in the best interest of residents of Mohave County that
these roads, paths and ways continue in existence for the use and benefit of the
public
THEREFORE, BE IT RF~OLVED that all roads, paths and ways within
Mohave County are and shall remain the sole jurisdiction of Mohave County for the
purpose of deciding what level of maintenance and construction is required and/or

BE IT FURTHER RE..SOLVED tl18.t any regulation proposed by federal agencies
()J' (~()ngress which would extinguish, limit. preempt or otherwise affect these roads,
paths or ways across public land shall require County approval as per the County - s
"Interim Land Use Plan" adopted April 18, 19~)4.
