RESOLUTION 94-92 WHEREAS, the Board of Supervisors of Mohave County met in Special Session this 14th day of March, 1994, and; WHEREAS, the state, counties, cities, schools, businesses, volunteer groups and Arizona taxpayers are continually facing the financial burden of frivolous and unfair Ii tiga tion, and; WHEREAS, criminals continue to sue home owners, prisoners continue to sue the state, and drunk drivers continue to sue their victims, forcing the people of Arizona to pay for these lawsuits, and; WHEREAS, current language in the Adzona Constitution prohibits the people and their elected representatives from stopping the escalating liability crisis and; WHEREAS, hundreds of active civic groups and thousands of people responded to the need for lawsuit reform by contacting the legislature and by working in support of lawsuit reform legislation, and; WHEREAS, the citizens of Mohave County have the right to not be sued frivolously and the ability, through their elected officials, to enact laws that will put sensibility back into the civil justice system; WHEREAS, the citizens of Mohave County have the right not to have their tax dollars wasted to pay for frivolous lawsuits; We, therefore, members of the Mohave County Board of Supervisors support the modification of Article IT, section 31; Article XVill, section 5 and Article XVllI, section 6 of the Arizona Constitution; to be placed on the November 1994 ballot that will bring about lasting lawsuit reform and fairness back to the Arizona legal system. We also urge the Legislature and the Governor to enact Senate Bill 1305, which will serve as the efforts of the people and their elected representatives in stopping the escalating liability crises, ancl is contingent on the Constitutional modi fica tion.
