A RESOLUTION SETTING FORTH THE DEN;rAL OF THE REZONING OF LOT 10,
BLOCK D, MAIRLYN ACRES, ,]~RACT 1201, SECTION 26, TOWNSHIP 19
NORTH, RANGE 22 WEST, FROM: R-l/IA (SINGLE FAMILY RESIDENTIAL/ONE
ACRE MINIMUM LOT SIZE) ZONE, PROPOSED TO BE: R-l/15M (SINGLE
FAMILY RESIDENTIAL/FIFTEEN rrHOUSAND SQUARE FOOT MINIMUM LOT SIZE)
ZONE, LOCATED IN THE SOUTH MORAVE: VALLEY AREA, MORAVE COUNTY,
ARIZONA
WHEREAS, at the regular meeting of the Mohave County Board
of Supervisors held on November 2, 1992, a public hearing was
conducted 1:0 determine whE!ther approval should be granted to
William Kellen of Rialto, California, for a zone change from the
existing R-l/1A (Single Family Residential/One Acre Minimum Lot
Size) zone to R-l/15M (Single Family Residential/Fifteen Thousand
Square Fo01: Minimum L01: Size) zone, occupying the southwest
corner of Valle Vista Driv4~ and l.os Gauchos Road in thE~ South
Mohave Valley area, and
WHEREAS, Section 26 is located two (2) miles south of
Bullhead City's southerrunos1: boundary.
The subject property is
accessed from Highway 95 via Los Gauchos Road East approximately
one-quarter (.25) mile t~othe northeast corner of the subject
property, and
WHEREAS, review of floodplain map #040058-2445C indicates
the majority of this section to be within a designated

floodplain.

Surroundinq land uses consist primarily of single
family residential areas and vacant land. Source of water supply
and sewage disposal for this property is an individual well and
septic tank.
The applicant desires to split this 1.03 acre lot
into two (2) fifteen thousand plus (15+) square foot lots, and
WHEREAS, on October 14, 1992, the Planning Commission staff
recommended to the Plannin9 and Zoning Commission DENIAL of this
proposed rezone based on .~~Jletin ~o. 19, Guidelines for A02:roval
of Subdivisions from the Arizona Department of Environmental
Quali ty which states, II'Where both the water supply and sewage
disposal system must be developed on the same lot, the minimum
lot size shall be at least one (1) acre, excluding s.tn:!ets,
alleys and other rights-ofo-way. II
The Planning Commission ~3taff
suggested that the owner of the subject property present: these
conditions of approval to any potential buyer prior to any sale
agreement.
WHEREAS, at the public hearing before the Mohave County
Planning and Zoning Commission on October 14,
1992,
the
Commission recommended a conditional APPROVAL of the requE!sted
rezoning with the applicant understanding and accepting the
following conditions:

2. Submittal and recordation of a Parcel Plat prepared in
accordance wi"th Article 3.16 of the Mohave County
Subdivision Regulations.
3. 'I'he establishment of a minimum lot size based on the
size of parcels per the recorded Parcel Plat.
4. Each parcel shall have legal access.

The applicant submit to staff written approval from the
Mohave County Environmental Health Department Clnd the
Arizona Department of Environmental Quality.
10. The rezone shall not bE!come effective for at least
thirty (30) days after final approval of the change in
classification by the Board of Supervisors. Being
December 2, 1992, as per .!\RS 11-829E.
11. I f these conditions are not met wi thin one (1) year
this approval shall be void. If at the expiration of
this period the property has not been improved for the
use for which it was conditionally approved, the Board
after notification by registered mail to the owner and
applicant who requested the rezoning shall schedule a
public hearing to grant an extension, determine
compliance with the schedule for development or cause
the property to revert to its former zoning
classification in accordance with Arizona Hevised
Statutes Annotated, Title 11, Chapter 6, 11-832.

WHEREAS, the notice 0:[ hearing was pub!'lsh~91!1t m (~~h039)
Standard, a newspaper of g,eneral circulation in Kingman, Mohave
County, Arizona, on October 17, 1992, and in the Mohave Valley
Daily News, and posted October 15, 1992, as required by Arizona
Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Monday, November 2, 1992 DENIED this
zoning, changing the recommendation of the Mohave County Planning
and Zoning Commission.
