HomeMy WebLinkAbout91-201 __ _"......._.~~............ _..__c-,;...,,_ ~ >_.~. . .__'Y.=,:;;:':...o;;., ':';;-;:-.';~_--''''__ _ _ ,_ ..._.._ ~_ .""~=. h"__' .. ~~.. -...-.-..-....--- } >>~~ I I I "'" >><-.. ,~ -~""- RESOIJUTION NO. 91- 201 WHEREAS, a petition was filed with the Clerk of the Board of Supervisors of Mohave County, Arizona, on June 17, 1991, praying for the establishment of an improvement district to be known as the Golden Valley Improvement District No. II of Mohave County, Arizona, under the provisions of Sections 48-901 through 48-965, inclusive, Arizona Revised Statutes; and WHEREAS, after proceedings to that end duly had and taken pursuant to Arizona Revised Statute, Title 48, Chapter 6, Article 1, this Board did, on Junl= 17, 1991, set for publ ic hearing the formation of Golden Valley Improvement District No. II of Mohave County, Arizona; and WHEREAS, the Board of Supervisors did fix July 22, 1991, at 11:15 a.m., as the time and date of the hearing; and WHEREAS, notice of hearing has been given for the time and in the manner provided in said Article and as appears in affidavits filed with the Clerk of this Board; and WHEREAS, part of the land included in the proposed district has been formed into the Rancho Verde Improvement District of Mohave County, Arizona; and WHEREAS, persons representing 640 acres wishing to object to the establishment of the proposed district have, before the date set for hearing, filed their objections with the Clerk of this Boa.rd, 21 of whom appeared at the hearing and presented oral objections thereto; and WHEREAS, evidence, oral and documentary, has been presented to this Board and this Board has duly considered the same; NOW, THEREFORE, IT IS FOUND, DETERMINED, ORDERED AND RECORDED AS FOLLOWS: 1. That the petition presented to this Board as a result of which it set this hearing was signed by the requisite number of owners of real property wi thin the proposed district, and is sufficient. 2. That the public convenience, necesity and welfare will be promoted by the establishment of the district. 3. That the property included in the Rancho Verde Improvement District of Mohave County, Arizona, will not be benefitted by the establishment of the proposed district and is therefore eliminated from the proposed district. :7 ft. That all of the remaining property within the proposed district will bE! benefited by being formed into such district and that said proposed district includes all of the property that would be benefited by being so formed. 5. That the boundaries of said district are hereby established as those more particularly set forth in the Exhibit "A" heret.o attached and by reference made a part hereof. 6. That said territory is hereby declared formed into a county improvement district under the corporate name of Golden Valley Improvement District No. II of Mohave county, Arizona, by which name it shall be known in all proceedings. Said district shall be authorized to make nay local improvements and take all other actions and exercise all other powers of a county improvement district as may now or hereafter be granted under law. 7. Said district shall hereafter be body corporate with the powers of a municipal corporation for the purposes of carrying out the provisions of applicable law. 8. The Clerk shall mail a copy of this order to the Department of Revenue and to the County Assessor of this County pursuant to Arizona Revised Statutes Section 42- 483. 9. A copy of this resolution will be recorded in the office of the Mohave County Recorder. PASSED, APPROVED AND ADOPTED by the Mohave county Board of Supervisors on this 22nd day of July, 1991.
