HomeMy WebLinkAbout90-068 I I I RESOLUTION NUMBER 90-68 RESOLUTION OF THE BOARD OF SUPERVISORS OF MOHAVE COUNTY, ARIZONA DESIGNATING THE BOARD OF SUPERVISORS OF MOHAVE COUNTY HOUSING AUTHORITY AND DECLARING THE NEED FOR SUBSIDIZED HOUSING WHEREAS, the Board of Supervisors of Mohave County, Arizona dE~sires to assist the housing needs of low income persons in the County; and WHEREAS, under Title II of the Housing Act of 1974, as amended, the Secretary of the Department of Housing and Urban Development is authorized to extend financial assistance to Public Housing Agencies to provide safe, sanitary, and affordable living units within the County; and WHEREAS, A.R.S 36-1403 and 36-1404 allow a County by Resolution of its governing body to delegate certain duties, obligations, powers and rights to a Housing Authority; and WHEREAS, the Board of Supervisors of Mohave County, Arizona does not choose to delegate any or all of the powers conferred upon it by Article 1, Chapter 12, Title 36, Arizona Revised Statutes. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF MOHAVE COUNTY, ARIZONA AS FOLLOWS: SE:CTION 1. That the Board of Supervisors hereby determines, finds and declares, in pursuance of the Arizona Housing Authorities Law, as amended, that: (a) Unsanitary or unsafe dwelling accommodations exis.t wi.thin Mohave County. (b) There is a short.agE! of saf,e and sanitary dwelling accom- modations in Mohave County, Arizona available to persons of low income at prices they can afford. (c) Unprecedented growt.h has created a demand for low income housing which cannot be met by existing resources in the area. (d) Such areas in the County cannot be cleared, nor can the shortage of safe and sanitary dwellings for pE:!rsons of low income be relieved through the operation of private enterprise, and that provision of housing for persons of low income as provided by this article will therefore not be competitive with private enterprise. (e) The clearance, replanning and reconstruction of areas with unsafe and unsanitary housing conditions are public uses and purposes for which public money may be spent and private property acquired, and such are go- vernmental functions of state concern. I I I (f) Such conditions affect public health, safety and welfare of the residents and will necessitate excessive and disproportionate expenditures of public funds for public health and safety and other public services and facili- ties. (g) There is a need for a Housing Authority to function in Mohave County, Arizona. SECTION 2. That the Board of Supervisors of Mohave County is hereby designated as the Mohave County Housing Authority which shall have all powers set forth in Article 1, Chapter 12, Title 36, Arizona Revised Statutes. SECTION 3. That the Mohave County Housing Authority is a Public Housing Agency pursuant to the United States Housing Act of 1937, as amended, and is authorized to engage in or assist in the ctevelopment or operation of housing for low income families within the County. Section 4. That this resolution shall supersede and revoke the terms of all prior resolutions that. have dealt with and concerned housing authorities passed by the Board of Supervisors of Mohave County, Arizona.
