RESOLUTION NO. 90-327
WHEREAS, the voters of the State of Arizona are asked, on
the November 1990 General Election Ballot, to consider whether to
support Proposition 202, which proposes changes and additions to
Arizona Statutes dealing with solid waste management practices
and facilities in Arizona, and
WHEREAS, solid waste management policies and facilities are
an increasingly important and environmentally sensitive public
asset, and
WHEREAS, Proposition 202 misleads the public by failing to
cite current State statutes regarding a variety of existing
recycling programs, and would prescribe a less ambitious
recycling program than those currently in statutes, and
WHEREAS, Proposition 202, controverts current statutes
prohibiting (with some exceptions) new landfills from being
developed within 1/2 mile of major river, and allows new
landfills along Arizona's major rivers, and
WHEREAS, Proposition 202 will not provide ADEQ with legal
administrative enforcement authority to shut down medical waste
incinerators or leaky 'spElcial waste I landfills in the river
bottom until AFTER the damage is done and the groundwater and air
are polluted, and
WHEREAS, Proposition 202 redefines medical waste as "special
waste", permitting its disposal in ordinary solid waste
landfills, and
WHEREAS, Proposition 202 will have the practical effect of
encouraging importation of hazardous waste into Arizona from
other states as the result of a requirement to establish a multi-
state compact, and
WHEREAS, Proposition 202 reduces the waste indust:ry's
liability for landfill leaks and contaminated groundwater, and
WHEREAS, Proposition 202 deprives the public of its right to
know when groundwater contamination has occurred, and

NOW, THEREFORE, BE IT RESOLVED that the Mohave County Board
of Supervisors of the State of Arizona, do hereby express concern
for the Environment and the Health of Arizona and its citizens,
and urge the voters of A.rizona to yote "NO" on Proposition 202.
