FAGE i OF 3 MOHAVE COUHTY BOARD OF SUPERVISORS RECOROIHG FEE 0.00 HC RESOLUTION NO. 94-80 A RESOLUTION SETTING FORTH A REZONE OF 'l'HE E':; OF PARCEL 248 SECTION 36, TOWNSHIP 23 NORTH, RANGE 17 WEST, :FROM A-R/IOA (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A- R/5A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, LOCATED IN THE LONG MOUNTAIN PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 1, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to owners Patrick and Sybil Petry of Valley Center, California, and WHEREAS, the property is located approximately four and one- half miles north of Jagerson Avenue. The property is accessed via Stockton Hill Road to Jane Avenue, then east to Parker Street, then north to Deloris Avenue, and west to the property, and WHEREAS, there are several widely scattered residences in the surrounding area. A residence directly north of this property has access to electric and telephone service, and WHEREAS, the site is vacant and is located in rolling foothill terrain. A few washes cross the property from west to east, Bannister Street has been bladed northerly along the easte.rn property line, stopping short of Ruthe Avenue, and WHEREAS, review of Floodplain Map #040058-2155B indicates that the property is within Zone C, an area of minimal flooding, and WHEREAS, this proposal is in conformance with the L,ong Mountain Area Plan, and WHEREAS, at the Planning and Zoning Commission recommended following: public hearing Commission on APPROVAL for before the Mohave County February 9, 1994, the a rezone subject to the 1. Submittal and recordation of a parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102. 04-B of the Standard Specifications. 3. Each of the three parcels shall meet or exceed five acres exclusive of roadways. 4. Each parcel shall have legal access. 5. The parcel plat shall show any surface drainage and FEMA flood zones. 6. That the Board of Supervisors accept the dedication of a 35-foot roadway along Ruthe Avenue, 30-foot roadways along Bannister Street and Deloris Avenue, and 20-foot radius curves at the northeast and southeast corners of the parcel. The dedication required by the rezoning resolution shall be shown on the parcel plat and accepted by the Board of Supervisors upon parcel plat recordation. 7. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until parcel plat recordation. 8. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 9. If these conditions are not met within one year this approval will be void. I f at the expiration of this period the property has not been improved to meet the use for which it waS conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 13, 1994, and posted February 14, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ... ~. . .
