PAGE i Of 3 MOHAVE C~JHTY BOARD uF SUPERVISORS RECORDI~G FEE 0.00 NC RESOLUTION NO. 94-74 A RESOLUTION SETTING FORTH A REZONE OF TilE NE\ OF PARCEL 119, SECTION 13, TOWNSHIP 2l NORTH, RANGE l8 WEST, FROM A-R/10A (AGRICm,TURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) 'ro A-R/SA (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) IN THE GOLDEN VALLEY AREA, MOllAVE COUNTY, ARIZONA. ffilEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 1, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to owner Shan Gale of Golden Valley, Arizona, and WHEREAS, the property is located one mile south of Highway 68 and east of Bacobi Road. The parcel is accessed from Highway 68 via Bacobi Road, south to Abrigo Road, then east to the subject property. Although there are scattered residential dwellings throughout the area, most of the area is vacant land. There is a wash that traverses the site from northeast to southwest, and WHEREAS, there is a residential home on the west side of the property that is serviced by electric power and telephone. This area is located within the boundaries of the Valley Pioneer Water Company. There are also power lines located on the eastern side of the site, and ffilEREAS, the owner proposes to divide this 10-acre parcel into two 5-acre parcels. This division is part of a divorce settlement. The Judge ordered that each party receive five acres of a ten-acre parcel and that the party will execute any deeds or other documents as soon as practicable. This rezone will permit the owners to create a parcel division that will be in conformance with the Mohave County Zoning Regulations, and WHEREAS, the applicant applied for A-R/SA (Agricultural:- Residential/Five Acre Minimum Lot Size) zoning; however, the Planning and Zoning Department is recommending A-R/4A (Agricultural-Residential/Four Acre Minimum Lot Size), to ensure that the minimum lot size will be maintained exclusive of easements, and WHEREAS, at the Planning and Zoning Commission recomnlended following: public hearing Commiss ion on APPROVAL for before the February a rezone Mohave County 9, 1994, the subject to the . . The parcels be zoned A-R/4A (Agricultural-Residential! Four Acre Minimum Lot Size). 2. That the Board of Supervisors accept the dedication of a 50-foot roadway on the north and east boundaries known as Abrigo Drive and Bosque Road, and a 20-foot radius at the intersection of these easements. The dedication required by the rezoning resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 3. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivis ion Regulations and 102. 04-B of the Standard Specifications. ..- ." ,~ <:., )/t 4. The parcels will meet or exceed their respective acreage exclusive of road easements. 5. Each parcel shall have legal access. 6. The Parcel plat shall show any surface drainage and FEMA flood zones. 7. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 8. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. I, ..._'.... . .:~ ,~ . . If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 13, 1994, and posted February 14, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. " . <" ~..," r NOW THEREFORE BE IT RESOl.YED, that the Board of Supervisors, at their regular meeting on Tuesday, March 1, 1994, APPROVED this rezone as recommended by the Mohave County planning and Zoning Commission and outlined herein.
