PAGE 1 OF 3 ~OHAVE COUNTY BOARO OF SUPERVISORS P~CORDIN~ FEE 0.00 Ne RESOLUTION NO. 94-73 A RESOLUTION SETTING FORTH A REZONE OF THE swlt, swlt, SElt OF SECTION 20, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/IOA (AGRICUJ-,TURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) TO A-R/4A AND A-R/2A (AGRICUW'URAL-RESIDEN~'lAL/FOUR AND TWO ACRE MINIMUM LOT SIZE) IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 1, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to owners William and Effie Sotelo of Seal Beach, California, and WHEREAS, the Highway 68, north Roads. The subject Road south to Bolsa property is located three miles south of of Bolsa Drive between Verde and Colorado property is accessed from Highway 68 by verde Drive, then west to the property, and WHEREAS, the site is vacant, and the surrounding land primarily vacant with a few scattered residential dwellings. There are power lines located on the southern and western sides of the parcel, with telephone lines also adjacent to the site. There is nO public water system servicing this area, and WHEREAS, the owner intends to divide this 10-acre parcel into one 4-acre and two 2-acre parcels, and WHEREAS, review of Floodplain Map #040058-2325B indicates this parcel is located in Zone C, an area of minimal flooding, and public hearing Commission on APPROVAL for Mohave County 9 t 1994, the subject to the before the February a rezone WHEREAS, at the Planning and Zoning Commission recommended following: 1. The northern parcel be zoned A-R/4A (Agricultural- Residential/Four Acre Minimum Lot Size) and the two southern parcels be zoned A-R/2A (Agricul tural- Residential/Two Acre Minimum Lot Size). That the Board of Supervisors accept the dedication of a 50-foot roadway along the west and south boundries of this parcel known as San pedro Drive and Bolsa Drive, and a 20-foot radius at the intersection of these easements. The dedication required by the rezoning resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 3. Submittal and recordation of a Parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102. 04-B of the Standard Specifications. 4. The three parcels will meet or exceed their respective acreage exclusive of road easements. 5. Each parcel shall have legal access. 6. The Parcel Plat shall show any surface drainage and FEMA flood zones. l~~~.-:::~\ ,_. 7 . That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 8. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 9. If these conditions are not met within one year this approval will be void. I f at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832. "..-" WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County f Arizona, February 13, 1994, and posted February 14, 1994, as required by Arizona Revised Statutes and the Mohave County zoning Regulations. ~;'tl RESOLUTION NO. 94-73 Page 3 . .\. . . PAGE 3 OF 3 2K 2364 PG 948 (FEE~9+-12507) NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, March I, 1994, APPROVED this rezone as recommended by the Mohave County Planning and Zoning Connission and outlined herein.
