NO. 93-312, A RESOLUTION SETTING FORTH APPROVAL OF A PETITION FOR
THE ABANDONMENT AND REVERSION TO ACREAGE OF LOTS 1, 2, 6, AND 7,
BLOCK 3, MOHAVE BUSINESS PARK, TRACT 4029, AN EXISTING RECORDED
SUBDIVISION WITHIN THE NW\ OF THE SW~ OF SECTION 23, TOWNSHIP 19
NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHAVE VALLEY, MOHAVE
COUNTY, ARIZONA.
ffllEREAS, at the regular meeting of the Mohave County Board
of Supervisors held March 1, 1994, a public hearing was conducted
to determine whether approval should be granted for an amendment
to Resolution No. 93-312, which abandoned and reverted to acreage
Lots 1, 2, 6, and 7, Block 3, Mohave Valley Business Park, an
existing subdivision, and
WHEREAS, the Mohave County Board of Supervisors at their
regular meeting on September 20, 1993, acknowledged receipt of a
petition from resident taxpayers of Mohave County requesting that
Lots 1, 2, 6, and 7, Block 3, Mohave Valley Business Park, be
abandoned and reverted to acreage. This request was referred by
the Board to the Planning and Zoning Commission for review and
formal recommendation in accordance with Article 1.l2 of the
Mohave County Subdivision Regulations.
WHEREAS, the submitted Preliminary Title Report indicates
that the owners of this property al:e Landvest, Inc., a Nevada
Corporation, holding an undivided 50% interest, and Aaron
Goldstein and Rochelle Goldstein, husband and wife, holding an
undivided 50% interest in Lots I, 2, 6, and 7, Block 3, which are
a portion of the Mohave Valley Business Park, Tract 4029. This

WHEREAS, the engineer responsible for the preparation of the
drainage report and the design of Mesa Villas, Tract 4146, is
Stovall Engineers, Inc., Bullhead City, Arizona, and
WHEREAS, a statement referencing the abandonment and
reversion to acreage via Mohave County Official Records, Book,
Page and BOS Resolution Number will be recorded on the Final Plat
of Mesa Villas, Tract 4146, and
WHEREAS, the proposed Mesa Villas re-subdivision as
submitted and reviewed is a 3.2-acre parcel subdivided into 16
mul ti-family lots, the minimum lot size being 8432 square feet
and a maximum lot size of 9114 square feet, which provides a
density of 19.4 units per acre, and
WHEREAS, the proposed project lies entirely withi.n
floodplain designation Zone AO, an area of 100-year shallOW
flooding where depths are between one and three feet, per Flood
Insurance Rate Map, Community panel No. 040058 2445 B, March 15,
1982, and
,<"'" WHEREAS, the Preliminary Subdivision Plan and Petition of

by the Mohave County Board of Supervisors via BOS Resolution No.
92-178 June I, 1992. This resolution was amended by BOS
Resolution No. 92-276 on August 17, 1992, a condition of which
was the abandonment and reversion to acreage of the above
referenced lots prior to the recordation of the Final Plat, and
WHEREAS, the zoning for the proposed re-subdivision was
established by BOS Resolution No. 92-317 on October 5, 1992, as
R-M/8M (Multi-family Residential/Eight Thousand Square Foot
Minimum Lot Size Zone), and
WlIEREAS, in a letter dated August 13, 1993, received by
Planning and Zoning August 18, 1993, signed by Debra O'Hare-
Gri.ssom for LandVest, Inc., and Aaron and Rochelle Goldstein, the
following request is made: "As owners of the project known as
Mesa Villas, Tract 4146, we hereby request that the abandonment
and reversion to acreage as described in the Petition which was
previously submitted by the Project Engineer, Stovall Engineers,
Inc., be initiated. This is required in order to complete the
processing of the Final Plat for Mesa Villas, which is being
reviewed by your staff."

WHEREAS, on December 20, 1993, a Review letter was received
from the Mohave County Assessor-s Cartography Department
regarding the Mesa Villas Final Plat. This letter, and
subsequent telephone conversations with Cartography, indicated
that although it was the intent to abandon the 16-foot Public
Utility Easement common to Lots 2 and 6, Block 3, the verbiage of
Resolution No. 93-312 did not specifically address that
abandonment, and
WHEREAS, at a public hearing on February 9, 1994, the Mohave
County Planning and zoning Commission recommended Approval of the
requested amendment to Resolution 93-312 subject to the following
conditions, with the old language struck and new language BOLDED:
1. O~ the lots shall be abandoned. All existing streets
and rights-of-way shall remain.
2. The 16-foot Public Utility Easement common to Lots 2
and 6, Block 3, shall hereby be abandoned. 1. The lots
shall be abandoned. All existIng streets and rights-
of-way shall remain.

WHEREAS, the notice of hearing was published in the Kingman
Daily Miner, a newspaper of general circulation, in Kingman,
Mohave County, Arizona on February 13, 1994, as required by the
Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors,
at their regular meeting on Tuesday, March 1, 1994, approved this
amendment to BOS Resolution No. 93-312 as recommended by the
Mohave County planning and Zoning Commission, subject to the
conditions outlined herein.
