WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February I, 1994, a public hearing was conducted to determine whether approval should be granted for a rezone for the above described property to owners Brian and Jean Mack of Kingman, Arizona, and WHEREAS, the property is located north of Oatman Highway and west of Ramada Road. The site is accessed from Oatman Highway via Ramada Road, then north to the site, and '0', -;....~ WHEREAS, review of Floodplain Map #040058-2325B indicates this parcel to be in Zones A and C. The portion in Zone A is an area of 100-year flood, base flood elevations and flood hazard factors not determined. The remainder of the parcel is in Zone C, an area of minimal flooding. This parcel requires a Floodplain Use permit for any development, and WHEREAS, the parcel is vacanti the surrounding land in the area is vacant, with a few scattered residential dwellings. There are no public utilities on or near the site. There are dedicated roadways that provide aCcess to the site; however, none of the roadways are maintained by the county, and WHEREAS, the parcel is not located in the Urban/Building Overlay Zone, and is in conformance with the Golden Valley Area Plan, and WHEREAS, at the Planning and Zoning Commission recommended following: public hearing Commission on APPROVAL for before the Mohave County January 12, 1994, the a rezone subject to the 1. The three parcels will meet or exceed their respective acreage exclusive of road easements. 3. Each parcel shall have legal access. 4. The Parcel Plat shall show any surface drainage and FEMA flood zones. 5. That appropriate zoning, building, environmental and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel plat recordation. 6. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 and all other applicable provisions of the Mohave County Subdivision Regulations. 7 . That the Board of Supervisors accepts the dedication of a 20-foot radius curve at the intersection of Ash Drive and Ramada Road, and the granting of an eight-foot public utility easement on the east and west boundaries of the property. This shall be approved through the recording of the resolution authorizing the rezone, and that the dedication and granting be shown via an acceptance statement and identified on the Parcel Plat. .,.......... (...", 8. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 9. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification. RESOLUTION NO. 94-49 Page 3 ~.~I "., WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 16, 1994, and posted January IS, 1994, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, February 1, 1994, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
