PAGE i OF 2 HaHAVE COUNTY BOARD OF SUPERVISORS RECaRDING fEE 0.00 Nt RESOLUTION NO. 94-42 A RESOLU'l'ION SETTING FORTH AN ABANDONMENT OF A 40-FOOT INGRESS/EGRESS EASEMENT ON THE SOUTHERN PORTION OF THE E 151.50 FEET OF THE W 302.98 FEET IN THE SW\ OF GOVERNMENT LOT 4, SECTION 27, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOllAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 1, 1994, a public hearing was conducted to determine whether approval should be granted for an abandonment of the above described property to owner Bill Attwood of Bullhead City, Arizona, and ,,,",;' ., WHEREAS, the property is located three miles south of Bullhead City and west of Highway 95. The property is accessed from Pebble Lake Subdivision via Highway 95, then to Chaparral Road west to North Ruby Street, then northwest to Northwest pass Road, then north to the subject area proposed for abandonment, and WHEREAS, review of Floodplain Map #040058-2445C indicates this parcel is located in Zone C, an area of minimal flooding, and WHEREAS, the proposed easement is located along a section line and provided access to the property before the Pebble Lake subdivision was created. The property can now be accessed by using Northwest Pass Road which is a paved road that is located within the Pebble Lake Subdivision. The roadway dead ends at the applicant's southern property boundary, and WHEREAS, the utility companies servicing this parcel have indicated that they are not using the easement and service is provided from Pebble Lake Subdivision by Northwest pass Road, and .~/... ,-. '.:'1 , WHEREAS, the Mohave County Engineer originally recommended denial for the abandonment of the easement based on the following: Two parcels to the east of this property are served by this easement as legal access. This easement is a section line east/west corridor from Arizona State Route 95 toward the Fort Mohave Indian Reservation, and there is a potential for future further development in this area as a westerly extension of JOy Lane. The easement as it now exists makes a connection .. - . . Northwest Pass was dedicated in adjacent recorded Pebble Lake Subdivision Unit 3, Tract 1189C, to the south. If this easement is abandoned, then this traffic circulation will no longer be possible for emergency vehicles or local traffic. The Mohave County Public works Department recognizes that this right-of-way is only 40 feet: however, many other passable rights-of-way within this county are dedicated at only 40 feet, and WHEREAS, at the Planning and Zoning Commission recommended following: I.
